Copyright and illegal downloads?

If it was his private laptop he could claim ignorance and say he forgot it was running in the background. If the company allow personal laptops on the network he could claim its there own fault and then go down all the other routes with dpa etc etc

My mate's brother got the sack for looking at some very nasty pron at work.

He was a trainee something or other and had only been there a month, he didnt tell his family for ages. He just got up and left the house for 8 hours a day, very funny day when we all found out! He is a right tool though!
 
I can never understand this kind of thing tbh.

My friend downloaded a demo via torrent and got shut down though it was not illegal well so he says.
He was using a program called peer guardian which he says is meant to make it impossible for them to know what ya doing
or so he thought hahahahahahah.
 
lol he's an idiot, punishments in the extreme, copyright theft, courts, fine, i think possibly jail too but thats for extreme cases.

Last I checked, downloading a film wasn't a criminal offence, the police wont touch it, and the punishment is a fine.

Criminal copyright theft is very different. :)
 
Does "your friend's" company have stated explicitly in their IT Security Policy/Acceptable Usage policy that they monitor staff? If not there is sod all they can do and if they try and pull him up on it he can point out that they have breached the DPA by failing to notify staff of the monitoring that is in place, the reason for it and the consequences of it.

Thats great except covert monitoring is allowed for under certain circumstances.... I would expect that would cover illegal activities.
 
Do we even know if the company has an AUP? I'm betting they do, and I'm betting it says you can't do illegal things on there. It's not a breach of the DPA to know that someone is abusing your network.
 
Don't be absurd, you don't know what kind of job he does or what kind of connection he was using. I work for an 'ISP' and as well as our corporate network we also have various home routers around the office for testing, well, you know - our service with. These are the same types of connections people have in their houses and if you were stupid enough you could use them to download torrents with.

What's absurd about my post? I said IF torrents weren't blocked and IF there wasn't an AUP in place. I've worked in telecoms for nearly ten years, so I do know how it works.
 
If this is true then that's all manner of stupid from the employee, of all the places likely to be checking what is downloaded and to know what they need to about intellectual property rights an ISP comes pretty high on the list. Deleting the film won't make any odds at this juncture since the record of the download will already exist - if they apologise and emphasise that it was an error/misunderstanding then that might encourage leniency but I suspect dismissal would be the obvious recourse for the company, they wouldn't want to be viewed as taking an easy line on people who abuse intellectual property.

my friend has downloaded a torrented movie, he works for an ISP, he did it at work on his laptop. They sent an email this morning saying they caught him etc etc. What are the punishments? can he just delete it and nothing can be done about it ?

well give us some more details then....who sent you the letter saying they caught you ?
was it porn or just a theatre movie you downloaded ?
who is the isp ?

Ha !!! I did a similar when I used to go to school when I was still very young (around 13-14), I'd leave for school everyday, but instead of going off to school I just ended up in a bar drinking... I was a right alcoholic :o

Almost ruined my whole life... but as they say, whatever doesn't kill you makes you stronger :o

I must say though, after kicking my self for being such a loser, I have matured a lot...
