Injury lawyers

i just asked for the best injury lawyers- not opinions
try not being able to walk properly for the rest of your life, having hyper sensitivity maybe for life, not being able to wash or bathe.. having to get taxis, buses going to practise nurse 3 times a week due to an infection and trying to study for your last year of university. try being in hospital for a week not being able to move. i am not suing the NHS they do a great job. Its the AU at my university for offering no support. I am just wanting some legal advice - i might not even go through with it

Would your university not allow you to repeat your year or something? It sounds like (with medical notes obviously) you have very strong extenuating circumstances. I'd imagine a progress committee would have no issue with it should you need to repeat the year- heck if it's that bad they may even write off your entire year.

If you're infected I'm guessing it's a staph infestation, in which case to be fair, being tired is a severe understatement.

I would like to see this case get taken to court just to see the outcome.

Sorry you hurt yourself but I cant see how anyone could have done anything to make the situation different besides you not playing rugby.

Indeed. The only thing I can see being possible is the guy claims against the NHS due to the infection setting in...so long as it occurred under their watch, else, no dice.

As for the university offering no support, did you speak to them about it? Universities will help you out with regards to exams etc. etc. if you have extenuating circumstances which would prevent you from completing them, so long as you tell them. Sounds to me like you tried to struggle through the whole lot, failed and now want to sue the university for not helping when you didn't inform them of your injury correctly until after you failed.

At the start of every year we are informed of the situation with regards to mitigating circumstances and what the process is for applying for it. In your case it would be contacting the university as soon as you were able after the incident and they will start the procedure etc.

Who's the claim against? Depending on your level of play, it's likely the club itself has some level of insurance that you might be able to look into.

Rugby is a physical sport and not to be obtuse, but it's sort of expected. My Dad had four of his front teeth kicked out, his nose broken several times and finally his knee-cap kicked off before he was forced to stop playing. You say "try not being able to walk properly for the rest of your life", but my Dad's on his 3rd knee operation now and that's exactly where he's at.

I'm waiting my first knee op now thanks to boxing I dislocated knee hasnt been the same since. I can do most sport just starts giving out or getting painful. But I feel this was my fault for boxing in the first place as I made the decesion to go boxing. It wasnt like an air con unit fell out of the ceiling and landed on my knee :D

I guess in some ways you are right. I would have thought even with the AU president being an ex rugby club captain would be aware and would offer some sort of support. I thought I could push through my degree but depression from not doing any sport or exercise and lack of socialising finally got to me about half way and I just wanted to finish uni. Now I'm in debt with little to show for it. I just want to know which one is best to get some legal advice.

I WILL NOT SUE NHS! I JUST WANT TO KNOW FROM PERSONAL EXPERIENCE OR WORD OF MOUTH WHICH ONE IS BEST FOR LEGAL ADVICE

its about the AU not offering me support - i have insurance.
I know its a computer forum but i just wanted to know which one is best

Ok what type of support are you looking for?

Have you spoken to the head of your Uni?

Have you spoken to all the different management that run the AU?

Have you gone to the governing body of the AU?

Have you made clear what you want and require in writing and have they replied to you?

If you have clear case backing up that you have done all of this and not one department has helped you at all you will have a case if not you need to do all of this and be able to prove it.

On a side note you must go to one crappy Uni if they are not helping you at all this would to me be a clear and easy case were most people from an AU would be really supporting.

Unfortunately the way that I see this is likely to be the university's view too, they were not informed that it could have a negative impact on your degree and you never asked for help so they will effectively say 'tough'.

I know some people that didn't do much work because they couldn't be bothered and had 'better things to do' than their dissertation who then failed and THEN submitted a mit. cert. application blaming other people and things that they chose to do. As far as I'm aware it got shot down as they are not repeating their final year.

I failed mine due to not working hard enough, I know this and my results showed this, I admitted it was my fault and am repeating to get the best degree I can possible now (3rd only).

Best way to get some legal advice is to go and see a local solicitor, I know finances are an issue but these places that advertise on tv only seem to touch clear cut cases, if you contact them you dont speak to a solicitor, its someone best described as a salesperson and then they pass it on to a higher "salesperson" and if they think its clear cut enough you may be lucky enough to talk to a solicitor and then its a case of fill this form in and ill take a look, not really advice.
Thats from my personal experience anyway and mine was a lot more clear cut than your situation, and im still not decided if im proceeding with anything and that was 2years ago this happened so Ive got a yearish left to decide.

Dave.

If its advice you want go to the CAB or even a lot of unis that do law degrees run a 'law clinic' where you can get advise.

I dont think the president being an ex club member would make any difference, they would need to treat everyone the same and everyone needs to follow the procedures. Its the same as someone in your position but going 'he should have offered support because we lived together in halls' or so on.

I would ring the uni and ask if I can repeat the year and so on.

What legal advice do you actually want though? I'm not sure what legal argument you want to use or even are able to. Are you thinking "best" = "get you the most money"? As they don't work like that. Also, 'no win, no fee' isn't actually as straightforward as that. You'll always have to pay out if you loose. That's a fact.
What's AU?
You're best going to speak to your advisor about your course, they can help. I had to redo a year because of ill-health. They are very helpful. Go and speak to Student Services/Support at your Union who can help. It's their job. It may be worth approaching your Law School too as many run free clinics. We do at my Law School.

Surely its the clubs duty to report an injury to the AU. That is the whole point of the AU to support the sports teams and fund them, insure them, do all the paper work etc. Anyway this can be locked it hasn't proved helpful. I have no intention of suing anyone. I just wanted some legal advice from a free service.

thanks dave for giving me what i wanted finally

any advice on which one is best?

sports injury claim - broken leg playing rugby + infection = depression and **** degree result

TBH, get over yourself, or be prepared to never go outside your front door for fear of bad stuff happening. Its nobodies fault you got hurt, its just dumb bad luck. Accept, move on, live your life.

The injury was most likely reported but I suspect you have to also contact them if you wish to pursue support from them. As with most things these days if you want support you have to ask for it.

CAB is the best place to go certainly, but I'm unsure that they will be able to provide much more help.

Which is the most honest? Although I have heard most lawyers are good at lying. I have graduated now which is a good thing but no where near my full potential. There are several factors to look into i just wanted to know which injury lawyers was the best.

Can't say any of them would be any good. :p

As Dave said, real solicitor and/or CAB would be the best place if you wish to pursue this.

P.S the thought never occurred to me until I met a Canadian who said i should sue. I never thought about it.

Sure they weren't American? :p

Seriously though, I can't see there really being a case and you've not been left financially destroyed by this due to loss of earnings etc.
