Sorry to resurrect this thread, but I read something on PH forum which was quoted off mx5nutz forums which goes someway toward supporting the theory that having a solicitor with you will get you raped by magistrates:

Basically I was on a 70mph limit when I was detected by a Police Officer travelling at 105mph.It was 08:45 on a fine sunny Sunday morning and as stated by the Public Prosecutor there was little or no other traffic.The magistrate saw fit to ban me for six months with a £300 fine and I have to pass the driving test before I can get my licence back...
I do think however that the sentence was rather harsh as do my Barrister and Solicitor

I am making the assumption that said barrister and solicitor were with him. I've quoted a post by Jonny671 from here

If you notice he was nicked on the A2 in Kent, i was on the M2 in Kent, perhaps Kent magistrates just have a down on people speeding.

I honestly dont know.

A colleague is a magistrate and (at the time) his best advice was to get legal representation, be smart, grovel but the outcome all depends on what mood the mag is in on the day...


I dont think it makes 1 jot of difference going with or without a solicitor, in my case i look a bit rough and ready, broken nose, big lump etc and i have a non refined cockney accent and dont come over the best so i took the solicitor route.

I dont know what else i can say on this subject.

I was done in 2006 for 100mph on an empty motorway, 10am on Sunday in Cumbria there was nothing there, good weather. Caught from 1km away at the limit of the range of the LTI20.20 laser.

I got £150 fine and 5 points, no ban.

The LT20/20 has now been banned in Canada because it is extremely inaccurate, in one cause a prosecutor trying to prove its accuracy pointed it at the court room wall and it clocked the court house moving at 7mph, the Judge was not impressed. The reason you got off with only 5 points may be due to the fact that although the gun said 100 they could only actually use it to prove you were doing at least 85 due to the inaccuracy of the evidence
 
Right I suppose so. Sorry I didn't mean to wade-on with my size 10s, I was trying to offer another case. Should have left alone I'm sure!

No problem at all, believe me i have spent hours wondering what i should have done or not, not a problem talking about it.
 
Is it doing your nut in not being able to drive?

You should have some fun like financing revolutions or grab one of those off road buggy things that can do 40mph that they had on Top Gear and go annoy the local farmer :D

I havent had to go anywhere yet so its not been a problem so far :)

You wouldnt believe the drama i have had with the building inspector and the builders, this has been a nightmare and now we are 12 weeks behind because of this **** weather.

Iv got an Admiral multi car policy, and they have said an extra 150 quid, nothing at all really, but i suppose they want to keep my business.
 
Unlucky on the seemingly harsh punishment OP.

However, I never go above 100mph on any road. It's just a rule I always stick too. I have done in the past but I would not risk my license like that.

It seems that the magistrate has means tested your fine by noting that you were driving a 1 year old Porsche? (if I read thread correctly). To be honest, a £200 fine isn't going to cut the mustard for someone driving your car.

They ask you what you earn, the guide line is supposed to be 1 weeks disposable income after all outgoings paid.

They dont ask about bonus's or expenses though :)

Seems reasonable enough, to be honest doesn't sound like you are scared of £2k fine. Fair play to you :)

If I were slapped a 2k fine I'd probably cry!
