Hi guys. Looking for a bit of advice.

I went for a interview for job at a retail chain and after the interview got made a full time job offer. They asked if I could hand my notice in straight away as they were desperate for people, I also was given a start date. Less than a week before I'm due to start the manager has phoned up and she has had to withdraw the offer because it sounds like HR over-ruled her and wouldn't let a full timer start (apparantly it must have come to their attention once they tried to process my paper work). The problem been that I am now going to be out of a job after handing in my notice at their request. The store manager said she's going to "try her very best" to get the desision over turned on monday by someone higher up but in the mean time there is a very real posibility I will be left without a job on Tuesday. Can they do this to me? I unfortunatly never signed a contract but the job offer was made without stipulation and accepted by me. :(
 
You can probably sue them if you were promised the job, even though you didn't sign a paper contract.

Obviously all they have to do is lie, and then you have nothing to base your claim on.
 
not sure but thats bad mate.can't you withdraw your notice?

I'm not sure I'm a supervisor/manager for another retail chain and they had to get someone lined up to take the ball running when I leave on tuesday (after 4 years). I believe they have verbally offered it to an exsisting staff member. Full time positions are rare at this chain and so this will be a big step up in terms of money for him. I guess it would come down to the store managers desision but I think I'd have to eat humble pie if I went down that route :(.
 
No, you can't "sue" them.

If nothing has been signed then you're out of luck. For future reference, don't ever hand in your notice till you've had a written offer of employment and have signed and returned the Employment Contract.
 
well i hope it works out for you.i'm sure if your employer only gave the other bloke a verbal offer then you should be ok,even though the bloke probably won't talk to you

No unfortunatly not. They gave me a standard form to fill out and I promptly filled it in and handed in the next day. I was interviewed by two people though so if it came to it hopefully both wouldn't lie about the job offer been made and them requesting to hand my notice in ASAP. But then again it would mean nothing depending on the value of a verbal offer and acceptance.
 
Oh man that sux dude hope it all works out. Surely your work can cancel and put you back on the books. It will save THEM a lot of hassle keeping you...SURELY they can see that!

Keeping you vs. advertising for replacement, interviews, selecting new person, training blah blah blah.

They can simply say that the offer was withdrawn due to unsatisfactory references or some such excuse.

You have no alternative but to withdraw your resignation from your current job, which you can do afaik

So if I had a legal recording of this conversation confirming the job and salary, I won't have any claim?

Of course I will. The problem is that you need something to counter lying.

If the OP was to lose a serious amount of money because of this, it is something to consider if you have evidence.
 
You had better hope your resignation can be overturned.

As has been said already, never do this without something in writing :(

Infact, never do anything in life (within reason of course :p) without something in writing, people will try and screw you at every opportunity.
 
Well that sucks. Quite stupid of them to tell you that you should hand in your notice ASAP though.

I guess lesson learnt, don't ever do anything without having it in writing :p

Aye that is true. Still they should take some liability if not legally then morally :(.
 
Oh my god, that is absolutely shocking. Are you on good terms with your current employer? Maybe you could say you changed your mind - better than saying you got rejected? If you can't get the job back then definitely go to CAB and take it as far as you can.

Hope you get it sorted out - that's really a nightmare scenario!
