As I said at the time: what Martin did wrong was not killing them both and then building a new cowshed over their graves or making 'em into pig feed.

Over here I've been told if someone breaks into your house, you can shoot them "so long as you feel they were a threat to your or your family". That came from a police firearms inspector. I see no problem with that.

Yeah it's a shame we don't have any rules for self-defence in this country. That's why there's all the raping.

Actually, our rules here are pretty similar, the only caveat is that your response is reasonable (ie in line with what a reasonable person would do).

This does not include people running away, or people only stealing property...

Most homeowners acting in self-defence never see court, it's only the ones who weren't acting in self defence (or where there is reasonable doubt they were acting in reasonable self defence) that ever get that far.

It is also worth remembering that Tony Martin would have been convicted in Texas, which has probably the strongest castle doctrine laws in the whole of the USA. You're still not allowed to shoot someone in the back as they run away, with an illegally held gun, then walk off and leave them to die.
 
First of all, Martin didn't call the police or ambulance either, but went to a neighbour for a cup of tea. He didn't tell them either. The first the neighbours knew about it was when the ambulance showed up. Which had been called by Fearon, the dead boy's accomplice. If Martin had done that one thing, he probably would not have been convicted. But combined with him opening fire without warning it was enough for a jury.

There was also the fact that Martin's defence were absolute idiots and refused to allow or suggest an alternative conviction of manslaugher on the grounds of diminished responsibility (which they probably would have got, and what it was eventually changed to on appeal), leaving the jury with no option but to convict for murder.

The ambulance was called by TMs neighbours when they found Fearon in their garden, he had a chance to tell them then as he knew the situation Martin didnt. He had no way off knowing how many was in the house if they got out if he hit them etc, he acted wrongly both with the actual shooting and his repsonse.
