In stopped traffic you should be aware of that possibility. I don't really think it's fair, but I am merely stating from experience that's the way the law is written in this country. Pedestrians and cyclists can do almost no wrong.

If you followed that to the letter you'd never be able to pull out of any road!

I know the law is relatively clear cut, but I think most courts have a bit of common sense about them to realise that he could be at fault here.

Still, its fortunate that he admitted liability, because if he did want to get arsey then it could get complicated, yes
 
Law is rubbish. AFAIK only things he says in the prescence of a solictor can be used against him in court, so if he did choose to sue you, his admission would have been near meaningless and he could have claimed he was disorientated by the adrenaline of being involved in an RTA.

Another stupid point of the motoring law in this country is that even if it was decided that it was 50/50 or knock for knock, he'd be entitled to claim up the damages to himself/his bike (but only get 50%) but you'd not be able to claim against him.

Again I'm just stating things as they are. I don't agree with them! You are lucky you ran into an honest cyclist who wasn't interested in taking you for a ride. Good thing you didn't swap details or his 'mate down the pub' might have convinced him to go down another route!

I guess he could have remembered my reg, but I'm guessing he'd have to go to the police and claim a hit and run if his mates convinced him to be a ****
 
Sounds to me like two agreeable people had an accident and came to a rational decision on the spot. One had the law on his side but recognised his actions were not necessarily the most sensible for the conditions and the other realised he could have done some harm to someone.

I think you both deserve a beer frankly; some of the people I encounter in the mornings I'd struggle to find the will to pee on them if they were on fire, they are that inconsiderate and wrapped up in their own pathetic, pointless little worlds.

I had a close call with one about a year ago pretty similar, so much so that I heard him shout 'noo' as we both came to a very close stop.

I think I was more shaken than him after we stopped. It was a horrible feeling, seeing someone about to potentially go under/over the bonnet.. even at a relatively moderate speed (ie him cylcing me pulling out)

Too true, I'm very grateful that he was a decent bloke about it. Likewise, I don't think it's fair to tar all cyclists with the same brush - plenty of car drivers and motorcyclists are just as idiotic

I could say that all taix drivers are imbeciles with no consideration and who will constantly cut you up because one or two occasionally do.
But Im not being stereotypical, am I?

At OP, while it is technically your fault there is nothing that could be done and you both sorted it out sensibly and hence deserve pat on the back :)

There are poor cyclists just as there are bad drivers.
One of the problems with some drivers is they can't wait 10 seconds to give people a bit of room.

To the OP, as said, sounds like you handled the situation very well. Stuff like this does shake you up, whichever side of the windscreen you're on.
