You are missing the point. This guy had his car damaged through no fault of his own. Why should he now he now have to drive an inferior car?

It seems these companies offer half of their promises as their definition of a comparable car is very subjective.

If it carries the same amount of people, takes as much crap in the boot and goes forwards and backwards then I'd class that as comparable.

Yes the guy had his car damaged through no fault of his own, but then is it fair that everyone has to pay an extra £50 a year on their premiums just because matey boy feels he should get a premium class car when he shopping trolley is written off? Nothing is fair, deal with it. We just have to choose the lesser of two evils.
 
One quick question, going on the basis the car is a write off, from the time i have until the car is taken away. Am i legally able to remove any modifications i have made and replace with standard parts? As i will probably be replacing the car with another C2 and don't want to have to buy these again?

I don't see why not, the insurance company generally do not replace modifications even though you declare them.

I am not a lawyer, but my opinion is that yes, you are entitled to remove whatever you want as its your car until they offer you a settlement figure which you accept.

Do be aware though that if you take, say, the wheels off and they collect a car with no wheels you'll receive a valuation that reflects that :p

The number of times I could have been hit by now is staggering, and there's a few times where I could have hit someone else.

This is one of the areas where my brother is complete fail, he'll be approaching a T junction and the car waiting has the body language of "I'm pulling out now", you can see the driver looking the other way. Then when we get there and the car pulls out on him: "Where the hell did you come from! WTF!". *sigh*

Depends what the modifications are.

Bigger alloy wheels and a bodykit? I woulnd't.

Headunit if you can replace it with the standard one or something small and not obvious? Yes I would.

Legally I have no idea, I doubt they want you taking much off it to be honest.

I've already removed the HU which i only got a couple weeks ago, and was also hoping to remove the custom exhaust (although from what i can make out, the exhaust is shagged anyway so won't bother) and induction kit
 
Given those criteria, not getting the E90 was a blessing in disguise :D

It would be pretty reckless for an insurance company to give a person accustomed to driving a FWD supermini, a RWD BMW. I'm glad they have more sense than that, even if it's for financial reasons.

Errr don't twist my words mini-Fox. I agree the 3 series would have been ridiculous but I still stand by the fact that I'd be disappointed with a 207 Estate if my C2 VTS/VTR had been hit and it wasn't my fault.

To be fair they are both pretty similar in the eyes of an insurer. Both are low powered, low end but not bottom of the range French hatchbacks. They won't have a C2 VTS or a Twingo 133 on hand just incase somebody with a warm yet not hot but not as big as a Focus hatchback has an accident.

The 207 won't fail to do something reasonable that the C2 is able to - whereas if you gave somebody with an E Class a Ka you could easily argue it won't be as suitable for long trips, or carrying people, or whatever.

Stop trying to invalidate my points by dishing out petty insults, it's repulsive and downright irritating.

So what if you get a car that isn't 'sporty'? The insurance company is obliged to give you a car suitable in needs, not so you can go for a spirited drive.

A 207 isn't awfully "Like for like" comparable to a C2 VTS in many other ways that they are a similar size and very broadly speaking the same class/style of car.

Working the other way that's like me expecting a Conti GT if someone ploughed into the Soarer.

No, it can carry more people in comfort and fit more than a loaf of bread in the rear. So in some respects the OP is better off.

There isnt much out there really is there? It's close enough.

And you would be in the right demanding one son, they dont make them fine cars anymore so you deserve something 2 door auto and fast, accept no substitute!
