Fair enough, sorry if im a bit short tonight...not been the best day
To be completely honest, i haven't even heard of that rule. And for the amount of time my car was suppose to be parked there, i didn't worry about leaving it there, like i said its a really quiet road, even without snow. Just waiting for my hire car to turn up, pushed for an E90, but after looking outside at the conditions, sort of regret it! lol
It is a complete travesty if they give you an E90. It completely makes a mockery of the whole like for like hire thing and I genuinelly hope if they do provide you with what you've asked for, the third party take it to court to dispute the charges. You pushed for an E90? I mean what? Why did you do that? What right do you have to have somebody elses insurance company pay for you to drive around in a brand new 3 Series because your 5 year old supermini has been written off?!
It is perfectly appropriate you should be given a like for like hire car as the accident was not your fault (Despite your rather stupid parking it was still his fault, however it was completely avoidable). A BMW 3 Series is not in anyones world a like for like swap for a Citroen C2.
It's abuse of the system like this which will eventually end up with a change in the law to prevent like for like hire.
Then park there - just don't be suprised when your car gets written off. It's not rocket science!

Unlucky mate, I learned the hard way about 3 years ago, parking on the pavement just after a bend on my estate.

Just abit of common sense/experience. Looks like a fairly steep hill hudging by the wall across the road, its snowing and theres a junction. I got hit twice in the space of a day because I parked up without really thinking about it as the snow wasn't that heavy the night I parked up.

With regards to the hire car, who cares? His cars been buggered, why shouldnt he get a nice hire car?
Its just a hire car after all what difference does it make?
Whenever I get a hire car, I pay the minium, but end up with Mercs etc cos Im a regular. I dont see a problem with this.

Because we don't have a legal system which awards punative damages? He is entitled to a car like his - which is right and proper. But his car isn't a 3 Series, it's a small French hatchback.
A huge difference. Credit hire is now a MASSIVE cost pressure on the insurance industry. Something like a 3 Series is hired out at a rate well in excess of £200 a DAY to non-fault accident victims. The third parties insurer then picks up the tab - and passes the cost on to future policyholders.
The law also requires that you take reasonable steps to mitigate loss. Hiring a £200+ a day 3 Series when you drive a C2 is not a reasonable step to mitigate loss at all. The third party insurer could succesfully challenge this in court as there is simply no way you could argue the hire of a 3 Series was reasonable.
Then somebody is left with a massive bill - potentially the OP if he hasn't read the small print properly.
If we all abuse credit hire now, one day we'll end up in a Ford Ka after somebody writes off our Audi A8 and we wont be legally entitled to anything better..
Thats a customer service decision taken by the rental company, who OWN the vehicles and can choose to absorb the loss in the interest of customer loyalty. Absolutely not the same thing at all.

Whilst I feel sorry for the OP, Fox does have a valid point. Was a pretty dim place to park as odds are someone would come down the hill like a tool and bin it.
We live on the top of a 1 in 4 hill (which comes off of a mile long hill). If anyone parks on it when it's snowy, that'll be my bumper. Sod the kerb / garden walls / lamp posts, the car parked on the hill will be my target.
To be fair people don't usually park there, but last year some cars were left there in the bad weather
. Cars are struglling to come up or down the hill as it is, so go and add in a chicane why don't you .
And as for the bloke at the top of the hill, he always washes his car when the first frost is forecast. I kid you not, first frost of the year he will wash his car and all the water flows off his drive straight onto the hill and freezes over night. Happens every year. Heck even people at the other end of the road notice and comment on it.

i live on a steepish hill and a bit of a bend.
I always park on the inside, every year i see at least someone misjudge their speed and crack into the car thats parked on the outside...
saw one today too, didnt stop so took his details and reported it to the police. not a huge amount of damage but you can never tell with new cars, but at the least it was a new bumper and rear 1/4 panel (heavily scratched)

They don't get a choice! They simply get provided with a bill, after the event. Which they can only dispute if it's deemed unreasonable (Which a 3 Series hire certainly will).
You clearly know NOTHING about how all this works, so why argue about it?
He has ZERO entitlement to request a BMW 3 Series. Why did he even do that? Does he drive a a similar car to a 3 Series? Nope. Infact his car is about as far removed from a 3 Series as possible. There is absolutely no way that billing the third party insurer for the cost of hiring a premium 4 door saloon car due to the write-off of one of the smallest 3 door hatchbacks on the market is reasonable.
He'll get a shock when it gets to court - I can't see any insurer rolling over and taking this.

OP have you requested that that other insurer provides you a car?
I had a Mini Cooper S to replace my Teg at £160 a day.... It was only when it got to £10k and I told the insurance company did they sort the silly offers they had been making.... its a bit of a joke really. I think Helphire work on recovering 25% of the hire costs, in my case the judge used Avis rates to determine how much should be paid.
Looking back on it all its just stupid and is the prime factor in all these 'OMG my insurance went up'. IMO E90 for a C2 VTS is a farce, what happens if that gets wiped out again like this?!?

The only clarity really needed here is who offered you? If its an insurance company its not really the issue that is probably being cited.
As we can now see the insurer has taken his request with the disdain it required and provided him with a more reasonable replacement vehicle. I suspect they simply laughed it off and didn't offer it to him at all, all they did was inform him of what the next car 'up' was.
Lets hope he doesnt get that written off by refusing to realise how where you park can affect how likely you are to have your car crashed into. Do people not think about ANYTHING these days? He's not even acknowledge that it was a daft place to park..

Surely its the other parties insurers that organise everything for the written off car, or is it him that organises it all, and pays it all, then claims it all back?

However, if they had just dropped off whatever they had left, and it happened to be an E90 then surely the insurance company would only pay the hire company a standard rate?

So Fox, just out of sheer interest do you consider the fact that he got a 207 estate make as much of a mockery of the like for like hire car system as asking for a E90 is?
A 207 estate is not much more "like for like" for a Hot Hatch than a base model E90.
This is a fair question. If Fox got so upset that it looked as if he would get a 3 series (which I completely agree with), how do you feel now it's gone the other way? That to me is not a like for like vehicle.
I used help hire and they were awful, I ended up with a passat in an awful condition (both mechanically and in appearance) when my Leon Cupra R was damaged. Wasn't impressed with them at all but I'm sure they did nicely from the 3rd party.
