Rear ended :(

Think you've said it all there. It's law for a reason, and you've stated the reason....yet, the law that is OCUK seem to have an issue with those who actually claim against their policy.

Falsely claiming, ie, for 'whippy compo innit' not for actual injuries. I'd only claim for personal injury if someone managed to break bones/actually hospitalise me, for whiplash? I'd be a man and ignore it unless it stopped me from working (in which case it'd most likely hospitalise me).

I'm doing what? I'm not being a hypocrit at all......If i suffered personal injury I would claim. That's what I pay hundreds a year to cover myself and my car for.

The guy suffered what he says was 6months of pain and uncomfortableness......unless you can proove otherwise, why not back off the guy for doing what 99% of the world would have done.

You'll be saying next that we shouldn't claim for accidents either becuase that put policy prices up too :rolleyes:

So you are saying he didn't suffer then......why didn't you just say that. Manning up and ignoring injuries will get you an award you know :rolleyes:
 
Love all the anti compo whinging in here......yet, you can bet your back side that they would all follow the same claim process for a personal injury had they been in the same situation.

Who gives a monkeys what he got......we pay insurance to cover us for halfwhits driving into us and causing damage/injury. How injured would someone have to be before the OCUK clan didn't bother hunting them down with the PC stick.

I have been in a rear ender situation, experienced discomfort but not claimed. Why? because there was no "injury" and I had no right to claim.

That was a general post about ocuk motors and the view on compensation claims, not directly aimed at MH, as what I quoted didn't appear to be aimed at MH.

I've never been out to get free money, I've been in a few accidents in my time and never have I tried to get money from anyone. In fact, I've been involved in one that was my fault, a sub 5mph shunt, my car was mangled (205) and the van I went into barely had a scratch and the person driving that and his passenger both attacked my insurance co for whiplash and personal injury. It's rubbish like that which annoys people like myself, Fox, and most of the other normal people in this thread.
 
My accident pre-dates this.

So my point stands, I did not lie and those invoice figures are correct.

There were still upper limits before this, it's just these are the ones corrected for 1st June 2010 (with VAT changes/inflation etc i should think).

Why is it that whiplash claims have become a massive issue since the introduction of no win no fee? Is this a coincidence? Surely with the advances in car safety, the numbers would be dropping, not rising.

Whiplash is hard to diagnose and easy to fake. 99% of the time people see pound signs after the accident, it's an exploit that needs to be prevented.

I'm not a doctor.....if a doctor has said he's got the symtpoms of whiplash, who are you to argue?

Unless scans show up muscle / tissue / bone damage then the doctor is in no better a position to say you have whiplash than you are to say you have whiplash if you wake up one morning with a stiff neck having slept in a funny position. His word is just taken as gospel by claims companies because he is qualified.
 
Let us not forget the golden rule. Money makes the pain go away.. oh wait.

Maybe next time I get injured by no fault of my own I'll start suing people, perhaps it will the next big thing. Honestly, I've had sports injuries that have been more serve than the whiplash I've had.
 
Sorry to hear about the crash Mikehiow, hopefully all okay.

I had a similar one in my EO ST last month. Subframe bent and floor pan warped. So far damages are 7500k and its in this week being fixed.

My missus and baby were in the car which was parked when some woman rear ended it at 40-45 in a 30 zone said she did not see the car. Baby was fine and missus has whiplash but no one seriously injured so thats good.

Hopefully you get yourselves and the motor sorted.
 
I've been a passenger in a couple rear enders.

First one I was a toddler, car hit us from behind on the motorway. Their car was a write off and I slept through the accident :D No claim.

Second was during a school run, I was sitting in the back of a W124 estate 7 seater where I was facing the rear. Car literally crashed 2 feet away from my legs, I laughed it off because it was my friends mum who had crashed into us. No claim.

I think you're a bit behind. Mikehiow has already had the car fixed, had the insurance claim sorted and has raced a broken M3 since he started this thread.
