in theory yes, they can penalise them for not fixing current complaints, but only if ofcom have instructed them to do something and they haven't, then they can be harsher with them if they take the view that developing and releasing something that is not sustainable, or something will further any existing unfixed problem, is in defiance of what thye have been instructed to do....
The trouble is that ofcom has become an industry tool, and is so hard for the average man be heard, that they are effectively useless to us, we do not have time to spend hours and hours dealing with their proceedures
They would be better off trolling forums and reading what people have to say, but they are not going to come out of their corporate meetings unless there is an incentive in it for them
