Court Summons

Given that the threshold for referring to the magistrates is 50, and she was caught doing 52, she was only just over the limit so may only get the points.

How long has this been the case? My first and only SP30 was for doing 55 in a 30...mobile van back in 2007.

3 points and a £60 fine. I was under the impression it was court if you were caught doing double.
 
Surely a ban for anything under double the limit is pretty rare?

The threshold for referring to the magistrates is 20mph above the limit in a 30, 25mph above the limit in a 40 and above.

Its therefore entirely possible to get a ban doing a 70 in 40, which isn't double the limit. Neither is doing 100 on a 70 limit motorway.

The fact that they can give a ban for 22 mph over the limit without the option to buy yourself out of a court summons is disturbing imho.

this only applies for a 30mph limit, for 40mph and above its would need to be 25mph over the limit. And even then its the possibility of a ban. The magistrates still have powers of discretion so can choose not to ban if they so wish.
 
I always understood you had to be doing 26 mph over the limit to get a ban.

I was caught doing 81.6 mph in a 60. But when it eventually got to court six months later, the paperwork said 86.1 mph. Just over the 26 over. Cost me 14 days :(

I suspect that if I wasn't an Englishman travelling through mid-Wales, I wouldn't have ended up with a ban.
 
Go to court and tell them you'll try harder next time to clock a full ton.

Whats the deal with these short bans then, are they logged on your license and do you have to declare them to your insurance company, or when getting a quote? :confused:
 
Yes

they show up with the same offence code, e.g. SP30, but under the points column they say 28d for 28days or whatever is appropriate.

When declaring your ban to the insurer, you tell them what the fine was, and how long the ban was, and the offence code. Some insurers (eg direct line) will point blank refuse to insure you with a ban. But most others are perfectly fine with it. They just raise your premium accordingly. When doing online quotes, just select 0 points and pick the number of days under the ban column.
 
I suggest that's the last time you let her drive your car if she can't keep her pedal happy foot calm. You would definitely be doing her a favour. She'll be looking at 6 points and 100-200quid fine.
 
i got so lucky when i got a £60 fine and 3 points it seems (52 in a 30). I simply told the copper i was lost (i was) and was totally honest in saying i thought it was a 60, and if he had pressed the gun a few seconds later i would have been doing 60 etc :( the Copper was great, even helped me find my way home lol
