Just found naughty pics on preowned PS3 - what would you expect as compensation?

compensation is for souless immoral people who are stupid enough to believe that money will fix everything
...Or for people who have had harm and/or loss visited upon them, and who rightly need putting back into a position they were previously in. Compensation culture is going mad, I agree. But that doesn't undermine the concept of compensation itself.
Hmm, in two minds on this one. One half of me says "free porn, potential Facebook antics, legendary thread in the making!"
Other half (soon-to-be parent half) feels "shocked & outraged!" that this could happen and feels like giving the store in question an almighty bollocking.

True, but speaking a someone bringing two children up myself I agree with Tefal and others. It's still your job as a parent to check these things BEFORE you let little tykes loose on it. Certainly in the case of pre-owned. A word in the right ear at the shop, definitely. Compensation?? LOL...

so if osmeone through no fault of their own gets injured due to somene else being negligent and can never work again... you dont think thats a valid case for compensation?
You get something for nothing and at the same time address a genuine problem within the business in question. What's the problem?

The whole point of compensation is about Equity.
There is a maxim in Equity that equity is a shield, not a sword. Meaning you can only use it to defend, so unless you are hurt, you can't sue just because you wanted to.
The other point of compensation claim is that, contrary to popular belief, it is to put the Claimant back on where he was before the incident took place, with money as the measurement.
So if you have a broken leg, there is a value to that as stated in the Judicial Studies Board Guidelines.
If you bought a faulty PS3 and it blows up and set your house on fire. You will be compensated for the COST of repair of your house back to what it was before. So if you had leather sofas, you will get a leather sofa back. If you had garden furnitures in your living room then you will get garden furnitures back. The key here is there can be no betterment to the Claimant.
Here, in this case...to put the Claimant back on where he was before...before you saw the porn? erm, unless you are psychologically hurt then you can't sue. Besides, it is very difficult to prove psychological damage anyway.
So, I am not sure what the OP is getting at in terms of compensation, if he is asking for a new PS3 then he has news. He can't. The compensation, at most, is the shop format the PS3 for him. Yep I was thinking of a free game. I'll post later to reply to a few people who have peeved me off. The pictures are pretty sick not your standard collection. The guy who sold it said it'd been wiped clean. It could have easily been accessed by kids, which to me is a huge concern.

So in your book, the 'lady' who drove straight into the side of my car at 30mph because she was picking makeup out of the footwell at the time, writing it off and putting me in hospital for a week, didn't need to compensate me?
I shouldn't have had my car replaced to equal value, or have my loss of earnings refunded? If you crash your car, or someone burns down your house, you won't be claiming to be put back in the position you were before?

I don't think you want compensation. Rather I would raise the issue to the manager of the store about their practice if you got it from a store.

50 years ago it was also acceptable to beat your wife and openly discriminate against race/gender.
While I agree the claim for compensation in this case is laughable, there is nothing wrong with compensation when it's done correctly. I bet if you were the victim of someones carelessness in a major way you'd be first in line.
