Surely the fact that it's written by the husband will start alarm bells ringing?

If she isn't going to pay, it'll make very little difference to her.

It was a rear end impact so it should be very simple.

If she felt nothing why did she pull over and exchange details ?

His excuses won't wash, hopefully they won't with admiral either. Let us know how you get on.

Mate of mine had a similar example. He's a taxi driver and was sat waiting outside somebody's house for a pickup.

Woman across the road pulls out of her drive, doesnt see him and smacks straight into him. She's very apologetic, admits it all and says she was in a rush and didn't look where she was going. He takes details and agrees to claim off her insurance.

Next thing he knows, he's getting a phone call from the husband that night.Telling him that he's a dangerous driver and that he has witnesses that he was speeding like a madman at the time of the accident and they won't be admitting fault.

They produce said fake "independent" witnesses and claim off his insurance. He is found at fault. :(

Some people just deserve to rot in hell.
 
What a total moron/tart.

I'd always go straight to the insurance in this situation unless the damage was negligible, for this very reason.

I hope you get it resolved.
 
My first instinct when I get in a non fault accident is going to be whipping out my mobile and getting video footage of the scene asap, in 720p, iPhone4, no big deal, just posting from my iPhone on way home via 3G

I had photos of the scene for an insurance case where the person crossed the white line and hit me on my side of the road.

I had pictures of the skid marks left on the far left of the road, and of the damage to my wheel where i had moved as far left as i could go to get out of their way.

Unfortunately because the photos didn't actually show the accident they insurance co. refused to accept them.

The only video that will be of any use, is one that shows the other car still wedged into your back bumper.

If like most people an accident happens while your moving and you end up pulling over afterwards to discuss, there won't be anything you can take a video of that would be useful.
 
Couldn't you take a video of them confessing to it, and the two damaged vehicles? That would surely tip things in your favour to some degree.

Emotional stuff aside, it's worth considering the downsides here. If you inform your insurer, and for whatever random reason it goes 50/50 or against you, can you withdraw the claim and fix it yourself?

The damage is minimal, and the bumper isn't going to rust. I can't imagine a bumper respray being more expensive than your excess and/or the loss of NCB?

To that end, it might be worth running some quotes to see what happens to your premium even with a non-fault claim?

I'm not saying back down, just go into it with your eyes open and understand the consequences if things don't go to plan...

In answer to your question you can settle the cost youself and they will reinstate your no claims bonus. think you have 12months to settle
 
I had a woman reverse into my Caterham 7 in a supermarket carpark whilst I was stationary once. Her husband went of to get some paper and I then 'found' some in my breifcase. Whilst he was away I got her to write down what had happened and sign/date it.

My insurance company said it was worthless as she could claim she was 'in shock'. It does seem unless you have a heap of credible witnesses no other evidence would help.

But at least it served to dissuade her from changing her story. I was terrified she would say I had driven into her.

The third party denies a collision took place. In the event that the OP cannot prove contrary, Admiral could take the view that it's not worth the cost of fighting it (with themselves apparently). They've got to pay the repair bill anyway, why would want to add legal dispute costs to their liabilities?

I hope it's an open and shut case, but with the way this has turned, I think it's sensible to consider the worst case scenario and make a judgement of if it's worth the time effort and potential expense of fighting the good fight.

Morally/idealistically it's crap, but RL has all sorts of external context that mean if you look at it objectively, you might take the view that the damage isn't worth your time fighting it...

How much is a repair likely to be? Price up a patch job, and a mint repair, then decide if it's worth pursuing...

If you decide it is worth fighting, good luck doing all you can to nail the devious ****** to the wall...
 
This - doesn't matter if you hesitate. The person behind shouldn't assume that you are going to go just because there is a gap. I will admit that it does annoy me when the person infront does this, but you don't ram their bumper!

This completely. And certainly don't blame yourself, blame her :p

& I also agree with the comment above. Hope the insurance rips this stuck up bitch off in future.
