Gave parking ticket to someone else and now being threatened with a fine

Only the police or local councils can give out legally enforceable parking fines, as this is NHS it'll just be some private parking company working on their behalf.
None of whatever they may threaten you with would hold up before a court, just forget about it. See here

ps: - I particularly like the new private parking outfit listed there
'PMSL Parking Ltd' :D

Haha! That's pretty good! And thank you for the info.

You would need to read the T & C's displayed on a sign in the carpark it's normally next to the machine.

No matter if it's a NHS carpark or not, it will be managed by another company that can impliment there own rules etc.... It's not against the law to give your ticket to another driver but it is frowned upon in the car parking owners rules as they loose out.

My advise is read the T & C's and check if they are clearly visable if not then use that as a get out clause other than that it's upto the warden or the company he works for to bother to chase this up.... Fine's of upto £1000 is unlikely as the cost to put this through a small claims court it's not worth it.

Failing that you could stalk the warden over a week and let his tyres down on his car every day, curl one out on his windscreen, put a dead fish in his car air filter etc etc etc......

I had this exact same issue last year in a hospital car park. I just looked at him, shook my head and drove off. Nothing happened.

seriously they can't fine you

they can't even enforce the parking charges if they give you a ticket, Private Parking Firms are notorious for idle threats. NHS carparks are not council or government run, they are managed privately. My GF works for the NHS at a hospital and has accrued over 200 tickets, of which she has paid none. She receives letters threatening fines and bayliffs, they are yet to turn up

Sigh,

I get a ticket everytime I go to my local hospital. Nothing ever happens.

I wish more people understood the law in this country, instead of crapping their pants and/or getting really riled and angry about it.

A) You dont have to pay ANY parking ticket unless its Council or Police. FACT, end of.

B) If it IS the council, just pay if your in the wrong, they eventually can arrest your wages even for crap like this.

C) A non Council parking ticket should be housed in the nearest bin.

I highly suspect your hospital car park will be private, someone like Vinci or some other such cowboys.

It's simple, if it's not a police or council ticket, you don't have to pay it, regardless of the terms and conditions of the car park.

Parking tickets are non-transferable. It's technically fraud.

Sorry, but that is utter bull.

Yes, they are "non transferable", but if you do so, you are merely breaking the T&Cs, which is a CIVIL matter. NOT fraud.

If you break the T&Cs, then they may invite you to leave their property. Or try to take you to civil court for "damages". Or tell you you can no longer park on their property.

Like the others said, warden can go jump. He is welcome to examine the CCTV or any other "evidence", and welcome to see him in the small claims. Any "fine" issued is a civil matter and is not enforceable apart from bringing it to a civil court (small claims etc). Which they wont, since there is zero chance of them winning.

Oh noes a £1000 fine!!!!!!121!!!4325

Private parking firm = private parking ticket (unless you've got one of those backward councils), private parking ticket = no fine, but they can chase you for their "damages", that would be the £3-£4 for the unpurchased ticket.

In West Bridgford (Notts), Rushcliffe have made all their ticket machines request a registration number to prevent the ghastly practice of passing on a paid for ticket. £1000 pound fine is not enough imho to prevent this vile action and any perpetrators should really be flogged in public to within an inch of their puny lives. Disgraceful maggots on the apple of society.

There’s enough crime in the UK without you adding to it, criminal!

We've got those near where I live, a bit daft really since I can only put the numerical part of my reg on the ticket :/

Technically, they could sue you and win, but:

1) They'd have to positively identify you as the driver and get your name+address
2) They'd have to demonstrate that you knowingly accepted their t&c's and subsequently broke them
3) They'd only be able to claim actual losses.

(1) is a practical impossibility unless you actually volunteer the information at the time, which you're under no obligation to do.

I got fined £60 for doing myself out of half an hours time.

Basically we have scratch cards. I arrived at ~1400 and marked arrival as ~1335. In reality I had scratched a 1 hour card and only used it for 5 minutes and had to move to a different car park so re-used the remaining time.

Basically some jobsworth had looked at CCTV for my actual arrival time and done me for "marking an invalid arrival time" (which is a rule to stop you scratching ahead and getting more time than the car allows, not to stop people getting less time ) They do not specifically state they cannot be transferred between car parks.

I wrote an extremely stern letter that indicated they were committing an act victimisation etc etc. Got an apology back and a cheque in the post for the £60 fine.

If anything comes of it, onus is on them to prove it really. Fight it.

dont worry about it, beyond them having to prove you gave a ticket, which would be very difficult, i would think the only person they would be able to fine would be the person who would use the ticket.
