I live next door to this Indian restaurant and I hardly hear them during the day and My computer blocks out any talking during the evening but they close at 11 yet every night between 1.30 and 2am they are shouting and talking very loudly. Amount of issues I've had with Indians or Pakistani's during my life time if it's not with BT India, taxi drivers, scammers and now these next door neighbours. Would reporting it to the council do anything?, I've recorded it on my EVP recorder as evidence.

Moving out of my parents place so far has been the worst mistake I ever made and this is not good for my health

Burn the house down, get your rent and deposit back (gotta make it look like it's not your fault) and find a new place to live.

Bonus points for suing your landlord for dodgy electrical wiring which has left you so traumatised that you can no longer sleep indoors.

Go move back in with your parents, I'm sure you'll fit in quite well with the other 32yr olds living with mum and dad...........

Or, try and be an adult and solve a social dispute by talking to them or going through the appropriate steps with the council.

Or, get some ear plugs and get over it?

1) No

2) I'll visit the council office tomorrow

3) I have ear plugs, I can still hear them :(

You can't need the sleep that much if you are up at this silly hour on the forum!

Sounds like the inconsiderate nature is annoying you more than how disturbing it actually is. From past experience, I imagine this means you are particularly stressed.

Go and talk to them about it tomorrow.

And go to bed!

why dont you go and see them, tell them they're keeping you awake and if they dont stfu you're going to the police..

tell the police if you ring, you think someone has broke in as the noise they're making is huge

Well they are open tomorrow(well err today) for business, I'll go in and complain to the manager

I wouldn't "complain" as such. Just mention that you live near-by and their late night activity is keeping you awake. Just a friendly request to keep it down a bit. Hopefully they will appreciate that you went to them personally and not straight to the council. I know I would.

Hmm.

I have to throw a spanner in the works here, because you have to accept that you moved next door to a buisness that is open till late, the family who run it all day then have to tidy the place up and shut up shop properly.

After thier day is done, I think they have a right to let their hair down before they themselves go to bed.

I wouldn't kick up a fuss, I would take a life lesson into where you choose to live and give other people the right to be as well. That said, I would deffo pop over there and say hello, be friendly, then over time once you are well known to each other mention the noise.

If things don't work out or even if you are looking for a self solution look into cheap sound proofing, an egg box wall covered with different materials to make it look pretty can go a looong way. I know, the mother of my youngest son and I had to do that to muffle out our own bedroom noise so we didnt disturb our neighbour, true story :D

TLDR? Bend like the willow, do not break like the oak.

The law doesn't work like that, Everyone works some do nights some do days but the law applies more so beyond 11pm. Even pubs have to abide by rules.. Basically you're saying that it's acceptable to make a lot of noise if it's to let your hair down.

It's acceptable during the day, they are running a business but from 1am especially 2am it isn't. Ive spoken to them and i've dropped a letter of, I've spoken to the landlord and they will talk to them later. I've warned them that if they don't keep it down I will go to the council.

No ifs or buts there is a law and there is a limit not every bloody night

Noise nuisance

A nuisance is often difficult to establish but, generally speaking, if something is unreasonable to the average person, a court might decide it is a statutory nuisance. Noise nuisance is covered by Part III of the Environmental Protection Act 1990 (EPA). This law empowers local authorities to deal with noise from fixed premises (including land) if they consider that the noise amounts to a statutory nuisance. Proceedings may be taken against noise from factories, shops, pubs, dwellings and stationary vehicles.
