Leaving work without notice

Depends how long you've been there. Also (I think, willing to be corrected), if you receive pay and a payslip, you're under a statutory contract..

Under one year. And the working year is January to January so no conflict with holiday pay etc. Is it "statutory" to leave notice if you haven't read, signed or verbally committed to a bespoke contract?

Also, if the employer has sent a text calling you a Joke and that you don't know what stress, can you take this further in anyway :p

Why would you do this anyway? Always leave on good terms, its a reference if nothing else.

Bullying mainly and bad working conditions. (This is for a family members job, not me personally)

I never understood this, surely its up to you whether you leave and when? if you don't need a reference, just stop showing up for work surely?

It's not like they can sue you, or can they?

No, a joke is a joke, don't take it so serious

1 week but if your friend knew there was a longer notice period they could press it was accepted implicitly.

There's laws on harassment, seek advice if you want to.

keep a record of the bullying and then just stop turning up.

If they kick up a fuss about it - constructive dismissal.

This is of course on the assumption it's the actual employer doing the bullying and not just another employee.

Also, I'm not a lawyer, so ignore any advice I've given =P

You dont have to give any notice if there is no contract as you say,i don't have a contract at work,so i can start a new job tomorrow if i wanted to.

From the sounds of it, this is deeper than just a few jokes, sounds like this "work related stress" is pretty serious, have you spoke to management?

No you cant.

Everyone has a contract, even if you dont sign one by working there you have a contract which is formed in several ways. Do not assume you can do as you please as you cant.

I have a zero hour contract if that makes any sence,i get rolled up holiday pay put on to my hourly rate which is £1.04 a hour, dont ask me why it works like this as don't know,i can sit at home for weeks without any work and don't get paid a penny,i can leave right now if i wanted to and they couldn't do nothing about it,just like i can't do nothing about it sitting at home because they have no obligation to guarantee me any hours,if the work is there i get it.now try explaing that to the job centre if i have a few weeks without work, they just look at me like i have two heads:(

How do you afford a computer? and internet and food on a zero hour contract?

Most of the time i earn good money when work comes in,so i just try to spread it out, like next week i am due £1000 in some wages,i'll try and stretch that out for 2-4 weeks if need be.

I get really peeved by the amount of time wasters who think they are entitled to wander in and out of any company any time they please (without consequences). Genuine cases of harrassment etc aside. Be prepared to have any unworked notice deducted from your salary/holiday entitlement (if any) because that is what i would do if you not working your notice for me caused me any expense or disruption of trying to find a suitable replacement without warning.

Edit: In answer to the original question I don't think it's valid but is considered very rude etc.

Self-cert the week :p

This

If they're genuinely being bullied, want to quit as a result of being bullied but the employer decides for some reason that they have to work a notice period then I'd be tempted to go off sick citing stress from the bullying.

hand in notice, then go sick for the entire notice period.. nothing they can do :)
If you need a reference though, always good idea to leave on good terms..
