Hit someone and a question as to fault?

Was following someone on a normal 30mph main road. Bake lights come on for no reason, he slows down, so i to pass him. He then turns right across and into me so i hit his rear wheel and rear quarter after locking up wheels.

He said he indicated but when i asked him to show me the rear indicator didn't work (his mum claims it worked before the accident).

Now as it stands it wasn't his fault if he indicated, but it wasn't mine i don't think as he didn't indicate.
Was a fault of his car.

Am i going to be bent over? :(
 
Can't see how thats anything more than your fault. Irrespective of his indicator status if a car in front of you slows down apparently for no reason the last thing you do is immediatly overtake them, as they are either:

a) Morons
b) Making a turn

Now be nice and don't dispute liability :p
 
If he was at a junction you shouldn't be overtaking past it anyway really

As annoying as it may be, you also shouldn't be relying on the signalling of other motorists, given that so many seem completely incapable of using them correctly.

On top of that, overtaking someone who has just braked 'for no reason' is probably not the most sensible idea anyway, as there may well be some sort of hazard you were unable to see.
 
Well firstly his brake lights didn't come on for no reason did they - they came on because he was slowing to turn!

It's regrettable that his indicator wasn't working, and that may transfer some liability to him, but he wasn't indicating left to suggest he was stopping either. You've chucked one down the outside which is at your own risk. Discretion is often the better part of valour when driving. If you've hit his rear quarter he was well on with his turn and so it sounds like you've come from a long way back.

Best you can hope for is 50/50, but you'll be lucky to get that IMO.
 
I remember watching an episode of one of the police programmes where they pulled a woman for not indicating and cited her for driving without due care and attention.
Not condoning the OP's action just throwing that into the mix.
 
Was he turning into a road? If he was, you were being extremely silly trying to overtake him there. He probably wasn't sure where he was, looking for road names/numbers/etc....doesn't that happen all the time when you're following somebody? Why did you try and overtake? :confused: Or what if he was braking because somebody/something was in the road that you hadn't seen - could have been very nasty.

From the sounds of things OP is a muppet. Indicators are mainly there for the drivers amusement what with the pretty twinkly lights.

Suck it up and let your insurance handle it.
 
I'd say it's the OPs fault, if they were indicating or not.

Why would you try and pass someone who randomly slowed down, and there just happened to be a junction near them? I'd check my surroundings and make the connection, regardless of indicators.

No you wouldn't, you'd barge past them and drive into them, just like on that roundabout :D
 
Thought so. Cheers guys. What about mirror, signal, manouvre? Seeing as ha missed 2 out of 3 lol. Not being nasty about it with him. Just not as clear cut as simply running into back of him.

Live and learn. Next time someone brakes for no reason with no indication I know to sit behind them til they get out lol.
 
Tbh I always assume every other driver is a complete retard with a specific wish to hit my car - case in point something like this I'd rather take 15 seconds longer on my journey to wait for said retard to decide what he or she are doing and/or graciously decide to signal that intent to other motorists than risk being retarded on.

Unlucky though bar a miraculous admission of specialness from the other driver it'll most likely be deemed your fault :(
