More increases due to 'inflation'!

Funny how my wages didn't go up in line with inflation :(

Price changes.
From 16 July 2012, we're increasing the monthly charge to phone and Mobile Broadband contracts that were set up before 8 March 2012.

If you joined Three on or after 8 March 2012, or you're on a 1-month SIM Only, Business or Pay As You Go plan, this price increase won't affect you.

If this affects you, you'll get a text, email or letter between 21 May and 1 June to let you know exactly how much your monthly bill will be going up by. The increase will start from your next bill date on or after 16 July 2012.

We've tried to make sure we tell you using your preferred method of contact. If you have a Mobile Broadband contract, you may need to check your dashboard for the text.

We've raised our prices by 3.6%, in line with the Retail Price Index (RPI) rate published on 17 April 2012. The RPI measures the average cost of goods and services across the country for consumers and businesses and we've brought our charges in line with this.

This price increase will be applied to your total monthly package price. The increase is not applied to any service Add-ons. For example, Add all-you-can-eat data.

We've worked out your increase based on your package price in April. The increase applied after 16 July may be different if you've recently changed price plan or renewed your contract.

Our terms and conditions allow us to raise prices in line with inflation so that we can cover our business costs. This means that you won't be able to leave your contract early as a result of this change.

While we know a price increase is never welcome, this is the first time that we've ever raised the price of our Pay Monthly phone contracts and we're confident that your plan still represents excellent value for money.

This doesn't apply to addons so my all you can eat data is not affected. I signed up on 27th Feb but since my tariff is £10 a month the difference it makes is minimal tbh.

I've not had any email or text notifying of any such increase though
 
Makes me laugh. I signed up with Three from T-Mobile and before signing on the dotted line I asked if Three had any sneaky price rises in the pipeline. The staff were more than sure there were no price increases coming. I laughed and said 'you tell me anything!' I knew they couldn't be trusted :rolleyes: I signed in April so shouldn't affect me. I wonder if it'll become an annual event now?
 
For me my £35 per month tariff will now be £36.25 and for new customer its only £34. Although it is in the T&C - it does feel like money grabbing and the service isnt great.

T&C’s Section 10.1(d) Within one month of a detrimental variation to your agreement.
You can end the agreement within one month of us telling you about a variation to your agreement (which includes your Package) which is likely to be of detriment to you. You must give notice to Three Customer Services within that month and your agreement will finish at the end of that month once we receive your notice. (A Cancellation Fee will not be charged.)

The agent on the phone refused to accept that this is in their own T&Cs and were very bad at handling my request which is now a complaint, I am deter minded to cancel as a matter of principal and have already ordered a GiffGaff sim.

As part of your right to terminate the contract because of new terms you disagree with could very well include their right to charge you for the outstanding cost of the phone, your possession of which requires the contracts completion for it to become your phone in law.

I expect they'll take it off you as they would your bill, so watch out for a few hundred quid leaving your account, if you close their access to the account before they take the sum they'll react in the same manner they would for any standard non payment of bill.

Buyer beware of small print.

Personally I'd have accepted the £1 odd increase, it is the first in 9 years they claim.

Nearly every phone contract I've seen has stated that the phone is separate from the contract

We may vary any of the terms of your agreement,
including our Packages, on the following basis:
(a) any updated Packages and new terms will be
available on our website and on request to Three
Customer Services;
(b) we will let you know at least one month in advance
if we decide to:
(i) discontinue your Package; or
(ii) make any variations to your agreement which
are likely to be of material detriment to you; or
(iii) increase the fixed periodic charges for your
Package (if applicable) by an amount which is
more than the percentage increase in the Retail
Prices Index Figure (or any future equivalent) in
any twelve month period.
You can end the agreement for such variations as
explained in Section 10.
Subject to the above, you will not be able to end the
agreement if such variation or increase:
(i) is due to changes to the law, government
regulation or licence which affect us; or
(ii) relates solely to Additional Services; or
(iii) relates solely to Add-on(s) (if applicable to you).

In such circumstances you will not be able to end
your agreement but you will be able to cancel the
Add-on(s) by giving us 30 days’ written notice; and
(c) if you carry on using Three Services after the
variation commences, you will be deemed to have
accepted the variation.
4.2 If we offer a range of Packages, you may change from
your Package to one of a selected range of other
Packages on such terms as agreed with us.

Were you able to cancel?
With Three raising the price and Sony going back on their ICS update for the Xperia Play I want to drop it like the plague.

So you can only end if greater than inflation.

You misunderstand. I think it says if change in law forces a change greater than inflation (or one of the already stated reasons), i.e. beyond what is stated already, then in addition you can't cancel.

It states they will let you know 1 month in advance if they increase their prices by greater than inflation. They haven't increased by more so they don't need to give you a months notice.

It then goes on to state that you can end your agreement subject to stuff explained in Section 10. You have failed to quote what Section 10 states. Going by the numbering system this looks like you have shown Section 4.1.

10.1 You may end this agreement in the following ways:
(a) In certain circumstances under our Returns Policy.
You may need to get in touch with Three Customer
Services to arrange Disconnection.
(b) You can end the agreement during your Minimum

Package) by giving notice to Three Customer
Services 30 days before the date you want to end the
agreement. However, you must pay us all the Charges
you owe, plus any Cancellation Fee for your Package

not contain a Minimum Term, or if you want to end
the agreement at the end of your Minimum Term
or any time after your Minimum Term has expired,
provided you give notice to Three Customer Services

agreement. (A Cancellation Fee will not be charged.)
(d) Within one month of a materially detrimental
variation to your agreement. You can end the
agreement within one month of us telling you about
a variation to your agreement (which includes your
Package) which is likely to be of material detriment to
you. You must give notice to Three Customer Services
within that month and your agreement will finish at
the end of that month once we receive your notice. (A
Cancellation Fee will not be charged.)

Section D is what you are looking at (ending within minimum term due to a materially detrimental variation to your agreement)

What 4.1 states though is that any prices rises LESS than the inflation rate is NOT considered a material detrimental variation to your agreement hence you cannot cancel due to this. If they raised it higher than inflation then that WOULD be a detrimental variation and you could cancel. They didn't so you can't.
 
So we are now paying £36+ and new customers are paying £29 for the same service, so they thought they grab money now - not think about the long term impact, when all these customers do not renew and leave including my self.
