Shall I CCJ them? I read somewhere that ebay's resolution system is rubbish and doesn't work but apparently because when you bid you enter a legally binding contract you can give them a summons through small claims court and they will either have to pay straight away or go to court where they will have no chance of winning and you get your money that way.

Has anyone ever gone down this route?

What's most annoying is it's the first thing I've sold on the bay, I recently sold something else and it went just how it goes when I buy something, he paid within the hour and I dispatched the next day. The most annoying thing is that this person hasn't even bothered to contact me but does have 87 100% feedback. It's just so annoying that people do this.

How long's it been? He might be busy, something might have come up, he might have got hit by a bus.

If I'm honest, more than once (including today) I've bought something from eBay knowing I can't pay for a few days, if the item will be gone otherwise.

Although always from shops, not private sellers who are likely to be actively waiting for my money.
 
How long has it been since the auction ended, it's not as if they "have" to pay within 24hours and people have lives which may keep them away from their computer and hence mean that they are unable to pay straight away.

CCJ would probably be over the top though, if they haven't paid eventually (and I seem to remember from other threads on here that they have a few days in order to do so) then just file a non-paying bidder thing against them on there and get on with your life.

edit: Their help pages indicate you can't open an unpaid item case until 4 days after the end of the auction so they have that long.
 
Just use eBay's resolution centre. If he doesn't pay within about a week then you'll get all your fees back and you can list again. Why you'd go down the small claims court route is beyond me. And as others have said, how long has it been since they won the item?
 
Just open a dispute like every other normal person. If they don't end up paying they will get an unpaid item strike against their name, simples.
 
Yes, you should take them to court and get a CCJ put on them, because that wouldn't at all be over the top, would it?
 
So how much is it for and how long has it been?

It's £5 and he won auction at 17.00 today :D

But on a serious note, I 'bought' something on eBay knowing I couldn't pay for a few days, and that extended by a few more, explained to the guy and he was like 'ah thats cool, least you let me know' or something like that, I did pay and all was cool.

Maybe RL problems? Maybe he was mis-payed and is waiting for the rest of his cash? Maybe his PC went bang?
 
maybe he wont pay because the seller left out major details.. like he has with this thread

so how much for and when did the auction end????????????????????????????????????
 
Which means jack****, they've messed me about and all they get is a tick next to their name which can't be seen by anyone else at all! Re-list the item and potentially get half what I should be getting.

Not pointless, 3 of those and he gets removed from ebay. This includes blocking his email and home address, not just the account.

You've just had a bit of bad luck, that's all. I've had 2000+ transactions on ebay in 18 months with only 1 problem from an actual buyer, it's just one of those things.
