As said, you must wait 4 days to allow buyer a chance to pay, after which you can enter a cancel transaction request via the resolution centre which if accepted by the non payer, will refund your final value fee.
If they dont accept the request then you wait a further 7 days or so and can cancel it yourself.

You can relist item or offer a second chance sale to next highest bidder at any time though. But please be aware the original buyer may still pay and expect the item within his 4 days slot

Had 2 non payers myself in the last week, and as far as getting half the value, its only worth what somebody is willing to pay, relist so it ends on a sunday morning or evening for maximum price.
 
lol just report and relist, unless you already sent it
maybe some things come up on the bidders end and cant get back to you.

Accept it and move on, this happens all the time on eBay. You are making yourself look a bit daft.

I don't look daft. When you bid on an item you are legally bound to pay for it. Perhaps if people took note of this and thought they could get a CCJ for ignoring to pay for items then it wouldn't happen all the time. Just because it's on the internet doesn't mean the behavior should be any different to that of a real auction house. Being allowed to screw over 3 people before ebay doing anything about it doesn't seem fair to me at all. You'd have thought ebay would look after their sellers a bit better seeing as that's where they get all their money from.

You still haven't answered what the value of the item is yet. Presumably since you are willing to go for a CCJ, it must be something like a car, or of that value.

All that matters is that the eBay system allows somebody not to pay and thus get a black mark on their account.

For future reference, you want to do the following when making a listing:

- Ensure that you put a timescale on how long they have to pay.
- Make sure that it doesn't allow bidders below a certain level of feedback, that way you can stop any poor seller who might have already got black marks, or new accounts.
 
Offline you can walk along into a shop, buy something, and if you change your mind, just turn around and give it back for a refund.

People make too much of a fuss about people not paying on eBay. If you went over to a pawn shop, they'd just rip you off, and if you had your own retail outlet, you'd end up paying rent, rates, and have to make allowances for stock that goes missing.

You 'look' absolutely ridiculous. CCJ's are used to claim debt, you are not a creditor. No service or transaction has taken place. You haven't sent the item and you haven't received the money. You would be laughed out of court.

CCJ is just a county court judgement. You bid on an item you enter a contract, thus if someone breaks this contract you can issue them a court summons. Ebay has a pretty good legal contract behind it and there would be no chance of losing. They'd simply ask if the person bid on the item, i'd have proof, then they would lose.

It's 4 days actually, I filed a report a couple of days ago and still no message from the winning bidder.
 
You bid on an item you enter a contract.

A bidders contract is with eBay. Not you, which is why eBay has it's own system for reporting non-paying bidders..

You start a thread asking if you should proceed with a CCJ, everyone unanimously says no, and you then proceed to tell everyone that they're wrong. :confused:

The issue also is that the Buyer might not be as bad as you make out (again, their feedback level and length of time on eBay is a factor in helping work this out - You have still given us no details). Perhaps the person has taken ill? Or is away somewhere? There could be any number of reasons why they haven't go in touch with you yet. If its a problem you take out an unpaid item dispute, they might well then pay you if they have had a reason they couldn't pay yet. Taking out a CCJ against them, especially when you haven't even heard form them is ridiculous.

From what I've read on Money Saving Expert, that while eBay is 'legally binding' its like eBay have their own law. Not much has really ever been tested in court to any effect.
 
Send the boys round to beat the money out of him. Maybe leave him with broken kneecaps, it's the only way to teach scum like this a lesson.
 
This happens a few times to me.

If someone doesn't want to pay they won't, as everyone has said you technically loose nothing by doing a non paying bidder . Also you can offer second chance

EBay side with the buyer anyway.

Sounds like he has paid over the odds, you thought..yes idiot has paid too much.. then he realised his mistake and you know you won't get that again.
I hope with all this fuss its a pricey item..if it a nudey pen..op will get mocked!
 
just phone the police and get them arrested for fraud and seek compensation for the emotional stress you are obviously experiencing
 
I had a bidder that wouldn't pay. So I file non-paying bidder claim. He finally pays 4 hours before the deadline. So I send him the item.

Low and behold, a week after sending the item, I get a message on ebay saying he hasn't received the item and will probably open a dispute with PayPal. Complete B/S but that's ebay for you.
