Someone drives into the back of me...now claiming i rolled back into them?

Make a video of your car (by a passenger) with it in gear, on a slight hill (preferably in the same place). Send this to the insurance company, do not give in...
Don't let them settle 50/50. Go as far as possible, and never give in.
I had a very similar situation, where i parked, and someone reversed into me whilst i was getting out of the car. They claimed I drove into them, and it took nearly a year to resolve, but i won in the end :)

Just keep telling them that you will go all the way to refute it. Take pics of the site, get as much evidence as you can. Stack it all up, and be militant about it!!
 
One thing ive learnt from dealing with road collisions is as soon as you get hit, get out the car and start rolling the video on your mobile, or atleast the voice recorder. You can't trust anyone nowadays.

Claim for as much as you can to get the car back to where it was condition wise.
Surely her initial statement will have said no witnesses?

I'm not quite sure how the automatic/hill thing works do they not roll due to the nature of the autobox?

As soon as you release the brake on an auto the clutch engages and itcrreps forward. On a flat road there will be no roll back, even on a steep hill theres only an inch of roll at the most. The road this accident happend on was flat.

Good call there, ill take some pics etc this weekend and get the gf to video while i demonstrate dsg creep on that road
 
I don't actually agree that DSG does creep, in my experience and by design it doesn't

What actually happened was that they didn't use to creep, but people complained that they didn't behave like an auto in that regard, so they modified the software to make it roll forward with foot off throttle. Every DSG I've ever used actually creeps.

I always wondered why my DSG creeped, I'd read they weren't meant to but mine certainly does.
 
Sad to see that the money we have to pay for insurance is used in this way. Had an accident 4 years ago where someboby drove into the back of my car doing at least 10-15 mph and then claimed that it was not him driving! Glad I had taken photos/video with my phone. Interesting thing is that I get a call/test message every year asking me to claim about whip lash injury.
 
Reading about things like this makes me sick to the core and glad I've never had a car accident. When I do I hope it isn't with some scum like described in this thread who will do anything to try and weasel out of taking the blame.

What has happened to society :(

Hope you get sorted OP, people not taking responsibility makes my blood boil.

My Mrs has just had someone reverse into her (she was stationary), the guy apologised at the scene, said "if I'd seen you, I wouldn't have reversed". Her car had no damage at all whilst the 3rd party had a small scratch (JML Magic Pen size). They exchanged details and went on their way. Cue the call the next day from insurance co, this fella wants to go through insurance claiming it will cost £150 to repair and that he will claim it against her?? He also said in the same conversation that his excess was £150! What a plank, he'd have to pay £150 anyway, get nothing through insurance and have the mark against his name, AND make it worse for my Mrs. Idiot!
 
DO not back down... your insurance company will try to go 50/50 but you dont have to agree.

Its for her to PROVE you reversed into her.. hers was the car behind so its her fault unless she can prove otherwise. A magic witness suddenly now appearing is bull... and make sure they know she admitted fault hence the texts.

I don't suppose you know where i can find the law/insurance guidance that states this? It was my belief that this was the case as well although my insurance co do not seem to be taking that stance

They will be simply seeking to resolve and move on for the limited cost to them and 50/50 will probably give them this. You need to be very clear in writing that you do not except the 50/50 claim and ensure you have an audit trail on all correspondence. I would put everything in writing (I also record my own calls for personal reference) and be very clear in every engagement.
 
Fight this hard, use those text messages to your advantage. I fail to see how the third party can blame you when she has offered to get it repaired at her brothers workplace.
 
If you have some details on her then do some background checking too, she might have a history of this and people who approach these things like this typically have skeletons in cupboards that it might be useful to understand.
