insurance increase - 3 points for talking on mobile

You're not allowed to use GPS devices while the vehicle is moving, hence the warning that pops up (that no-one reads) every time you start the device. Same goes for built-in equipment (car radio, cigarette lighter, etc.), or 3rd party devices mounted to the windscreen.

http://www.cps.gov.uk/legal/p_to_r/...guidance_on_prosecuting_cases_of_bad_driving/

That's if it actually results in injury/death? Obviously anything you do that contributed to that can be used against you.

Obviously I'm not going to change the radio as I'm approaching a junction, zebra crossing etc, but you are allowed to change the radio station.

My CU80 cost me about an extra £350 per year for the last 3 years, done the trick though as I have not touched the phone whilst driving since. How I received the CU80 though was the biggest load of **** ever.

It was a fair cop, not complaining about it, and the police were really polite tbh.

Annoyed with myself cos it wasn't a personal call it was work related and even then not in a good way, was talking to a bell end panicking and stressing me out over job that had gone bad that we were both supposed to attend that day, in the end i went on my own, sorted it no problems and no need for 20 panicked phone calls from this guy and no need for the points :(

Sucks that you're getting points and your insurance premium may rise, but maybe it'll make you think twice before doing it again. I guess I just don't see the need to be contactable 24/7 that everyone else seems to.

How difficult is it to wait until you get to your destination to answer a call, or find somewhere to pull over and turn the engine off? Better still, turn the phone off when you're in the car, then you won't feel the need to answer it.

I used to get pee'd off with agencies. They'd almost always call me when I was on the way home from a job, or if not then it was when I was having dinner or a shower.

I flat refuse to answer the phone in the car, handsfree or not. Don't care who the call's from.
If I'm having dinner, they can bog off too.
As for the shower, don't think the phone would like that very much. :)

I know he wasn't. Seemed like the perfect opportunity to have a rant about one of the things that gets on my moobs when I'm driving though :p

Nope, it covers careless driving through to much more serious offences. It's worth a read and not just a quick skim...

Still appears to me like guidance for CPS.

CPS are never going to prosecute someone for changing the radio station, because that isn't what this is for.

The context to me appears to be where there is dangerous driving as consequence of factors. Not that these factors = dangerous driving.

edit:

Even with handheld devices

The responses to the CPS public consultation on bad driving have shown how seriously society views the potential dangers of the use of mobile phones and other hand-held devices, whilst driving. In cases where there is clear evidence that the driver has been avoidably and dangerously distracted as a result of the use of these devices while driving, a charge of dangerous driving should be the starting point for the charging decision.

Even with handheld devices they have to show evidence of danger. Obviously if you're chatting or tapping away on your phone for extended periods of time that's easy to show. Sounds like you are allowed to be reasonably using a device even if you aren't handsfree, when at a standstill at lights for example.

Then it's a life possibly saved.

I think it's quite arrogant to think that most people are only concerned about the financial implications of using a phone while driving, rather than it's potential consequences of possibly killing.

Most phones are ok with a speaker phone on your lap.....not great but considering the £60fine and the £50 or so insurance hike....what calls while driving are worth £100.

Don't understand people who use their phones when driving. Make the call before you set off? Or pull over if you have to urgently answer a call? Saw someone actually writing a text whilst driving the other day
