Is there any law against a retailer putting something up for sale but refusing to sell it?
Just seems dumb that P4U offer it sim free but refuse to sell it sim free, why even advertise it as available sim free in the first place?
It's debatable: As I understand it, an advert is an 'invitation to treat', i.e. they are inviting you to buy at the advertised price. They don't have to accept your offer. So, if the price is incorrect (genuine mistake) there is nothing in law to force them to sell at that price. However, it's not that simple...
If the price or advert is deliberately misleading then they
could be breaking the law and at the very least, trading standards could be involved. If they're advertising for sale something they don't actually have or will get; or do have, but won't sell to you, or they advertise it at a price just to get you interested, to get you into the shop, only to up the price, then I would suggest that could be a case for Trading Standards/the courts.
The problem is proving it and unless the 'deception' was widespread and continuous, probably not worth the effort.
At the end of the day, our best weapon in fights like this, as consumers, is to take our business elsewhere.
