In terms of complying with a CSA decision... you by law do not have the right to question any decision made. The statue (Law) books say that if the CSA (Secretary of State) make an assessment that assessment is correct. No ifs, no buts, no fair trial nothing. I know it sounds incredibly difficult to believe but the above is true.

For the last 2years I have been requesting yearly FOI requests on them. Did you know last year Mar 2011-Mar 2012... 3,000+ males disputed parentage and paid maintenance whilst awaiting a DNA assessment and of 3,000+ cases the DNA was found to show 534 (15.X%) were actually falsely named on the papers! The scariest thing of all... that figure is just the fathers who were lucky enough to be able to afford the cost of the Paternity Test (because the CSA only recognise something like 2 different companies).
 
To atpbx... if you have a Court Order that states a monthly maintenance amount, after 12months the CSA can overrule any Court Order and impose a their rates and there is no come back for you.


I'm well aware of that, but after 7 years, I dont think thats going to happen.

The fact I am now at a point where next year I can kick her out of the house as a condition of the divorce is that she is only entitled to live there till our son turns 16, kind of gives me all the cards.

Go to the CSA, I kick you out on the street as of july next year.

I doubt I would do that, shes just going to get a tenancy agreement in the post to sign instead.

Actually... again it doesn't... under the guidelines (aka Law) she could claim Child Maintenance from you and apply under the Child Support Act to stay living there until your child finishes full time education. Usually 18 years of age, however from April next year... technically... she could stay living there until your "Child" turns 20... just so you know :)

I know of successful claims where maintenance has been awarded to 22year olds to force their dads to pay for their University living costs... (just so you know that means to the mother, with whom the child lives with and therefore thats where those costs go).

When the CSA become involved... you have no chips on the table

I garentee you by July next year she will be paying rent on the property or be out.

I'm not going into all the details, but I were you, I wouldn't want to bet anything substantial on this not being the case.
 
Oh i'm not saying you are right or that i'm wrong... but just so you know... if she went to the CSA she could legally stay in the house and there's nothing you could do... because the Law says that is what she is entitled to.

To get your "out of the house" statement... it means she hasn't gone to the CSA... if she cottons on that is an entitlement of hers there is absolutely nothing you can do about it.

Have a look on google for A Fairer CSA for All... it used to have a teacher on there who gave a 3 part documentary to his CSA story where they forced a Sale of his house despite him not being in arrears etc. There are some similar ones.

Going off FOI the CSA made 11 Children homeless last year through these tactics... there are potentially hundreds of second families who found themselves homeless that are not recorded.
