Where's Magick to tell him why he won't be?
Where's Magick to tell him why he won't be?
Things like this don't progress quite as quickly as they do on TV.
As for 'displaying' his 'evidence', can you really see the police saying, "Come on Sir, this'll all go away much quicker if you just pull it out". Imagine the lawsuit.
Assuming things are as the OP has posted (which does seem like there must be more to it) what can the OP's friend do about his stolen 360/PS3/mobile phone, and what comeback does he have against the police for putting him through this once he's been proven innocent?
I'm referring to them tracking who has actually been logging into the accounts recently. If it points to an address that isn't his or somewhere e has access to it suggests he is telling the truth at least
Wait!! What now??? It's illegal to get your wang out on the internet. Holy ****
Lets be honest, there is only one form of nakedness on the internet that the police will seize you stuff, and that's kiddy porn.
Either that or this thread is a load of BS.
Tampering with the evidence in anyway will lose all authenticity and integrity surrounding the guy who has done this. Therefore as a counter argument it could even be portrayed as you doing whatever has been done in court. Best stay well clear of accessing the account or trying to regain access.
Surely this has been taken forward into part of the computer forensic teams within the Police? The police have a large tool set that can grab many a detail off Facebook. Hopefully they will see sense and aim for an IP, or a status posted from a Location.
They were not stolen?
Now my friend has had all his electronic devices taken, Xbox 360, PS3 and his mobile phone.
Definition of theft:
"A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it"
Regardless of whether it's the police who have taken it or not, unless he gets the items back exactly as they were taken, I'd class that as theft.
There is nothing dishonest about the police taking electronic devices from someone suspected of exposing himself to kids online.![]()
Am i the only one who really wouldn't give a toss if i didn't see my consoles and phone again as long as i didn't get sent down for something i didn't do?
he will get them back, but it will take a long while. doubt they will just hand them back when proven innocent. if they've been sent to a forensics lab the police will need to wait for the forensic lab to release the items and send them back to them, then back to individual?
It is that serious, Other than harassing his existing friends, he's been adding random friends of friends. One of the messages he got to his new account was from a ****ed off parent, asking why the older account had added someones daughter. So yeah, It's that kinda serious
also, NOT SHENANIGANS. lol.
I wish it was!
My friend most definitely got taken away to to the police station, and most definitely had his stuff seized. But he is also most defnitely innocent, he's going on about suing due to things being done unlawfully and without proof.
And yes, His solicitor isnt coming back with much helpful information. Up until a week ago he was getting his stuff back, latest news found out a few days ago is it could be 6 months before he gets his stuff back. =\
So if a copper turned up at your door out of the blue one day and told you they thought you'd been up to no good and they were taking your stuff, you'd be fine with it? Because personally I'd be ****ing furious.
My God do the Police in this day and age not understand how computers and hacked accounts work?
I can imagine most people would. I don't know the law well enough, but I did think it was impossible to do that without due cause, which surely means a warrant, and those aren't easy to get without evidence? No!!?? (which is why I'd imagine some people are a bit suspicious of his innocence based on the current facts)
If they went in and nicked your stuff based on suspicion, unless there are some funky new laws after all this terrorism bs, I'd say you'd be well within your rights for a big fat apology or the option to sue.
