Someone drives into the back of me...now claiming i rolled back into them?

People might not want to claim for whiplash but the insurance/accident management company might convince them to as it's more money for them too.

When someone dinged me in the side at 5mph the guy asked me if anyone was injured 3 times in a row when I said no.
 
Aren't child seats meant to be binned after an accident, especially one significant enough to cause the child whiplash?

No child seats, no seatbelts just kids bouncing around in the car. Looking back I wish i'd have phoned the police or brought this up with the other driver but I was so angry at myself and it being my first bump I wasn't thinking.

That's exactly what stinks and why insurance premiums are so high. People won't change, if they think they can make some money by crying wolf, they'll do it. Insurance companies need to clamp down on these claims and as another poster has said impose strict fines, premium hikes and possibly refusal of insurance in severe cases to those fraudulently claiming.

Even if it reduced the number of claiming fraudulently by 1%, its still 1% of claims being dealt with legitimately!

OMG everytime I see Jeremy Kyle on TV I just pray that someone gets up off the stage and smacks him in the mouth and breaks his jaw rendering him a mute

Back on topic, people always try it on after the event, particularly if there were no witnesses or witness details taken. However, I should think the texts is acknowledge of blaim in itself.
 
The sad reality in all of this is that this isn't necessarily a rare thing to happen.

Luckily I have not been in anything like this before (touch wood!) but ive always been told by previously to never go for cash settlements and so on.

The fact of the matter is you can't trust anyone these days so the only way to deal with these situations regardless of how minor is through the insurance companies.

Sure no one wants to pay any more on their insurance but frankly you pay it for a reason and 9 times out of 10 people will go for the cash route because they know its a damn site cheaper for them than to go with their insurers.

I hope you crucify the scumbag and get rid of this nuisance soon...
 
Solicitors are due to issue proceedings on the other party anyday now.

I've also since sold the MK1 3.2 V6 TT which I had at the time of the crash and bought a MK2 3.2 V6 TT :-D

I've won! Her insurance company backed out once court proceedings were issued and paid out in full. Cheque is in the post and should be with me by the end of the week!

All's I can say is I am so glad I persevered and screwed the lying good for nothing scum over. The best justice is knowing her friends whiplash claim is coming out of friends pocket (well insurance co). She's lost some no claims and her insurance is going to go up come renewal :-D
 
Yup 7 months is pretty good going for a claim that's disputedmy car got sideswiped outside my house whislt parked after other party failed to stop at a give wa
That's almost 2 months mine has sent on for now
 
I would have thought that once you explain that you drive an automatic this should be resolved in your favour.

I don't actually agree that DSG does creep, in my experience and by design it doesn't, but an insurer will have your car down as an automatic which in 99% of cases do creep and therefore do not roll back as the claimant is suggesting.

My DSG creeps.

Just read the entire thread, glad you got it sorted. I've not had a bump yet, but dread the day I do because of people like this..
 
Now you can let us know her name and the company she works for. She doesn't work for a solicitors or financial institution does she?
