Someone drives into the back of me...now claiming i rolled back into them?

Great result in a pretty decent timescale.
My crash took 4 YEARS to conclude! First thing I did with the first settlement cheque was send a bunch of flowers and a "With Deepest Sympathy" card to the other party (lied their whole way through the claim!) :D
 
Could she technically be charged with fraud for this? Cases like this should be made to go to court, and if the judge thinks the person was acting fraudulently then their details should be handed to the Police.
 
Re: whiplash claims, isn't it the fault of these ambulance chasing wasters that call you after they find out you've been in an accident?

I've been thinking about this too. Would love for some of these insurance cheats to get some time for it.

I would love if this could happen but sadly the other party would only have to retract the claim that the OP rolled back and there would be no case.

But congrats on winning, 7 months isn't too bad. My wife was involved in an accident and it took a year to sort out even though it was pretty clear cut. Also took the threat of court action before they would actually admit it.
 
If an ambulance chaser ever phones me, I'll tell them where to stick their whiplash claim.

Unless I do actually have whiplash.

Before Christmas I went into the back of a woman who stopped at a clear round about. It was a minor crash but still we got out and exchange details. I checked my car and the bumper had been pushed back (I fixed it myself by reseating it). Her car had no damage at all. I could see she was in a bit of shock as she was starting to cry. I reassured her and said to remain parked and do not drive until she has calmed down. I said to have a look at the car later and give me a ring. I left at this point.

Three weeks pass and a claim comes through. I was annoyed as I asked her to ring me to discuss first. The claim wasn't for car damage but for neck injury. I was fuming. There was no way in hell she got an injury from such a small accident. I asked if she claimed any car damage but they said no. I said surly that tells you how impossible it is she has an injury. Anyway they said they will ask for a doctors opinion but I knew at that point I didn't stand a chance since doctors can't prove she doesn't. The next thing I hear about this weeks later is a note from my insurer telling me I had lost one years NCB due to a claim. I haven't chased it as I could have lost a lot more but I am seriously ****ed at this **** culture we have right now.
The government needs to sort these pathetic claims out. I wish I headbutted the bitch and broke her nose so she had something to claim. /RAGE

One thing ive learnt from dealing with road collisions is as soon as you get hit, get out the car and start rolling the video on your mobile, or atleast the voice recorder. You can't trust anyone nowadays.

I thought this too. Seriously good advice people. If you have an accident record everything. Wish I had :(

Fair play to you but I would have taken the free £2k-£3k. I've seen how easy it is to claim for whiplash first hand as my girlfriend got a £2500 payout after a minor collision on the motorway a few years ago. I would certainly claim given the chance.
 
Small update on this for everyone.

As i originally said, the claims management company dealing with the claim had a call from the third parties insurance claiming i rolled into her.

My insurance company (who had not had any information from myself or the claims management co) then wrote to me saying they were settling 50/50 as the third party is claiming i REVERSED into her and neither of us had independent witnesses. :S

Cue a heated call between the insurance company and myself, I send them copies of the text messages between myself and the third party offering to repair the car bla bla bla. As a result they fire am email over to the third parties insurance asking why she would offer to repair the car if the accident was my fault.

I today hear, bearing in mind we are approx 6 weeks on since the incident which was a small incident where there were no witness's previously....the third party now has a witness. Oh and her passenger has filed a personal injury claim.

Just to add -

I wont be making a personal injury claim myself. What i will however be claiming for is the fact i wish to sell the car and im unable to until the repairs are complete. My job role has changed which has caused my mileage to double (insurance co aware and business cover added to the policy). I shall be attempting to claim the lost value of the car over the time taken to settle the situation

I really don't have time to read all the thread but if you have legal cover ( I hope you have) then go to town with it.

Years ago I did, some bint turned right in front of me at junction saying I spun her round 720 degrees:rolleyes: Even the traffic cop laughed at that.

I tried to be nice and carried on until the very nice policeman said off the record this girl and her mate are trying to pin the blame on you so keep that in mind when I interview you.

Needless to say I did and luckily I had a witness that described things exactly the same as me.

After 10 months or so I "won" and her insurance had to pay out etc etc.

Pain in the bum mind. But like people have said stick with it assuming you have legal cover:)
 
Just thought I would post my congrats to the OP for pursuing the case and nailing the lying scum. I read the entire thread whilst eating my lunch and can't believe she even entertained the possibility of claiming against you.

Going 50/50 on small claims seems to be a current scam of car insurance companies, they take some of the small cost and in exchange they get to register a fault claim against you (and potentially wipe out your NCD if its not protected) meaning they take a larger premium from you over the next 5 years

Good to see you won in the end

It's pointless getting upset about the Car Insurance market. If the incentives are there it is human nature to manipulate the truth for financial gain. The whole thing is a farce.

Sadly those of us who are honest will always be penalised by the greed of payout-pursuing ingrates (by that I refer solely to people who make things up) and the interface of greed between insurers, solicitors and claims-management companies.

If people knew how serious whiplash injury can be and how it affects peoples lives they might think twice about lying for the sake of a bit of cash and increased insurance premiums for the rest of us.
 
Just seen that you won your claim. Has put a smile on my face to see justice done for once. You hear some ridiculous stories and I went through something similar in the past.
