Dangerous Dogs.

so the dog broke into your house / garden and attacked your pet? or did you release your pet into the area and hope it would not get attacked?

I'm struggling with this too as it isn't abundantly clear.

However, I'm guessing that if OP was able to find the dog by seeing it sat in a garden whilst driving, I'm guessing there is a distinct possibility the dog could have gotten loose.

Does it really matter, there's basically two scenarios here:

1) Cat was safely at home, dog managed to get in somehow and attacked the cat. Maybe here the dog might be classed as 'dangerous'.

2) Cat was wandering around unsupervised and came across the dog, doesn't really matter where, fight ensues, cat loses.

First one he's got a potential grievance against the owner, although god knows how it would get into the house.

Second one is far more likely and is just the risk you take by letting a cat roam free, most of the time the fight will be between the cat and a bird/mouse and the cat will win, occasionally the fight will be between the cat and something bigger and the cat will get hurt, seems like common sense to me...
 
Every dog I have ever known whilst growing up has hated cats, none of them have been devil dog children eaters.

My dog hates cats and I'm sure if he caught one whilst out in the garden he would probably try to kill it.

All dogs will chase cats, as cats often run, but if the cat stopped a hit back, the dog "may" attack.

So, what "pit bull" type dog attacked your cat?

My thinking was that it does matter insofar as I didn't want to make a crass comment about having no qualms with a dog attacking a cat on it's territory if that wasn't what actually happened. As I said, given that whether or not it was scenario 1 or 2 as per your post is not abundantly clear then, I find it difficult to make comments about how 'these things happen' when I know how horrible it is to have a pet injured.
