Being done for speeding

Happened in August, I was travelling on a 40 mph road when an approaching van flashed me.

Sensing something was up, I slowed down. Went around a corner and there was a speed detection van. I went past him at a legal speed and then just over an hour later, went back the other way, this time giving him a wave.

Six weeks later, I get a letter saying I was travelling at 56 in a 40, but in the opposite direction to where I was going.

I replied confirming I was the driver and asked for a photograph, also denying I was travelling in the direction indicated.

They have now sent me a summons and changed the speed, stating that I was travelling at 40mph, in a 40mph limit :p
 
You monster. When you see a speed camera you need to do half the indicated limit - 'tis the way, usually with excessive braking too.

Wow, sounds like a royal **** up to me. What are they doing?! That's pretty bad considering that many would have just paid the £100 and 3 pts and that would have been that. I'd be writing a letter of complaint.
 
I'd be kicking up a fuss about how it appears that they were initially lying. Trying to screw you over etc. etc.

Then demand a review and explanation of what happened and why it won't be happening again.

I bet the people in the van took an issue with the sarcastic wave.
 
Let them take you to court

Wonder what the judge will say to you doing 40 in a 40 you maniac :)
 
It's fools like you that are killers! Don't you know that doing the 40 mph could kill a child, where as if you were going the legal limit of 40mph the child would live???!!

Screw the points and the fine. Lock him up and throw away the key

What a joke - what are you going to do about it? Seems like such a waste of time and money not only for you but the courts and everyone involved. No wonder we're struggling in this country when all this bureaucracy causes so much unnecessary waste.

I did wonder that, but why say I was going in the other direction (which I can prove)? Am I to the victim of a Photoshopped image?

Does the photo confirm 40 in a 40?

Plead not guilty, take it to court and make sure you ask for costs when it gets laughed out the building.
 
If they've sent you a letter saying 40 in a 40 I'd be inclined to go along with the summons to have a giggle at their expense.
 
If you do some how get confirmation that it was down to the van operator taking exception to your friendly wave, then I'd throw a mail out to the press for the lols.

They sent the first letter assuming you'd be too scared to dispute it, 56 in a 40 would have got you a fair old rollocking. The 40 in a 40 is either a) a typo or b) the lowest they can change it to whilst still being registered as an offence but not deleting it from the system (which would probably need some kind of review, where the operator would be hauled up on it).

I reckon they thought you'd be too scared to contest, and now you've called them out on it they're back peddling. Have your day in court. :D
 
I'm pretty sure the actual van operator makes no decision on "who gets done" other than the camera picking up the right car. They can hardly rig the speed that it shows.

Will just be a stupid error and coincidence. I guess all you can do is try to answer the summons with an "are you sure " or turn up with a politely but firmly written defence
 
Careful, if this is a magistrates court then it could get more stupid yet.

My brother was summonsed for dangerous driving after a crash based on the statement of a local bobby that was an outright fabrication, my brothers lawyer tore it to shreds, basically disproving every sentence. My favourite was the statement said that the car was destroyed with front of the car crushed by more than a metre, we had a photo that showed the front of the car smashed but the slam panel undamaged. Another was the police photo showing full visibility when approaching the scene, taken by the bobby standing up, it was a blind crest.

The judge decided that the police had lied in their statement, but wouldn't have brought him in unless he was guilty... DD40 awarded.

They may be setting you up for something you're not ready to defend yourself against, such as say you passed their equipment at 40 but they both witnessed you speeding.

Just deal with it via letter tbh.

I had a similar thing years back, I was parked overnight in a lay-by near a speed camera,a few weeks later, via my then employer I received 4 NIP's through the post, speed Zero!

I requested photo's and pointed out my vehicle was stationary in a lay-by, with a tachograph printout to prove it hadn't moved for hours...

Turned out that the GATSO was incorrectly setup, every time a speeding car went past, it photographed whoever was in the lay-by! :D

I am surprised a camera van has made such a **** up, then again, if its operated by a human, human error comes into play!
