Right the girlfriend bought her car about 9 months ago all good the car went in for its MOT and they couldn't pass it due to a telltale light not illuminating. Further investigation has found the airbag light has been disabled which is now working again but we can't get it off so more investigations was done and its been found out now the front passenger airbags been ripped out and wires have been cut/switch removed

Now she bought it off a person she thinks im getting her to look into this now but shes going to have to get it sorted out but can we bring legal proceedings against the idiot who did this (Last owner only owner it had before but she will find logbook and check that)

9 months ago and she cant remember where she bought it from?

Unlikely if it was a private sale.

Private sale unfortunately in this case.

Seems might have to suck it up and get it sorted then. Found airbag cheap enough and ill get an auto electrician to fit/wire it back in

There's no proof that the person she bought the car had anything to do with removing the airbags, so you have no chance of taking any legal action against them.

I'm not sure this is a simple case of caveat emptor - the sole previous owner has had the air bag removed and crucially taken steps to hide the fact from the buyer.

What's to say a mechanic hasn't done it whilst the car has been in for some work?

IMO it's a massive waste of time and energy to do anything other than fix the issue before the car is driven again.

Do mechanics randomly do that off their own back? The standards of evidence required in a small claims court aren't the same as a criminal court. I don't how much it'll cost to put right, but bringing a small claims action costs only something like £50.

Dodgy ones? Sure.

"Please sir, my airbag light won't go off"
*sucking through teeth*
'ooooooooooh that'll be the banjo gasket in the trumpet head, gonna be expensive'
"Please fix it sir, I need my car for work"
*cut out the airbag and disable the bulb*
'All done sir, £968 please'

I'll be amazed if anything can be done.

It's one of those things - someone has been a moron, and done something massively stupid. That same person has then hidden what they've done from everybody else. You've found out a significant amount of time later - you cannot be sure who has done this.

Having 1 previous owner does not mean the car wasn't loaned out to friends, given to little Timmy to take to Uni for 6 months etc....

It's (unfortunately) a lost cause, imo.

Only passenger side airbag is missing sorry. It has been previously crashed but by her. Airbags never deployed though as i was in the car in passenger seat. Wonder if that is why they never went off (as one was missing).

Pretty stuck on were to go from here except sourcing a replacement which i have done (80 pounds used with a warranty) and having it fitted to get it through so she can atleast have her car back

I mean by the previous owner who may have pranged it, deployed the airbag, repaired it on the cheap and hence had to disable the airbag light

Ive not come across airbags being missing for any other reason
