Just a question. If the "woman" in question was so vilified by it, why did she not report it as sexual assault at the time?

John Luke Dale, who studies criminology at Nottingham Trent, was filmed on a mobile phone by a friend stripping to his boxers before shoving his penis in the face of a young woman after she fell asleep at a house party last year.

Although the incident took place last year, it did not come to light until the friend who had filmed it showed it to workmates, who called police.

Sounds like she didn't know it had happened...
 
Why are various posters going on about a 'drunken prank' as if his being drunk provides some kind of defence or mitigation? You remain completely culpable for acts carried out when you're wazzoed.

Because it changes the likely motivation from something sexual to simply trying to get a laugh out of your mates. Yes, the act is the same but the impact on the victim would probably be different. The sentence should account for this.

Having said that, people reported the video at a later date so I guess it was darker in nature than people first imagine.

Why would the impact on the victim be different? Should the victim feel less violated because the offender was "trying to get a laugh out of his mates"?

Possibly. It's quite personal.

If some dude put his nob on my face at a party because he was smashed, and he instantly regretted it after, I would be far less bothered by that than if he was doing it for some kind of sexual gratification.

Neither scenario is 'right' or excusable but the latter is more disturbing for me, therefore the sentence should account for that.

I've been to these kind of parties, it's no secret what goes on at these uni house parties. They are easily avoidable (i.e. don't go) if you are not 'in to' the getting drunk, playing drinking games, passing out thing.

Now I am not saying she consented, far from it. But you have to be really naive to go to one of these and not know what might happen if you get drunk, pass out, etc. It's a uni party after all. House full of drunken, horny, young adults...

The guy though should know his audience. This is what a lot of things come down to. I know out of my mates who I can slap round the face with my todger (both guys and girls) and nothing will come of it. Apart from maybe retaliation when I pass out.

End of the day he was stupid. If it was any other scenario, guy doing it to a guy, girl smacking her melons around the place to either guy or a girl or even sitting on their faces, it would no where near have gone this far.

Also, I don't get the thing with recording everything. You hear anough bad things coming of someone recording something. People don't learn.

Bottom line is he was stupid, his mate shouldn't have recorded it, he should have know his audience better. She should have been mature enough to not drink herself to oblivion and put herself in a vulnerable position. He should have been punished, but 9 months in prison and on the register is ott.

Agreed. If it's just for a laugh, then it is quite funny. If it's for a sexual kick, then that's a bit different.

Perhaps there was an element of actual sexual gratification here (beyond simply utilising a sex organ). The defense said no, per the article, but maybe the judge/jury thought different?
 
Being trusting of strangers is no way changes the particulars of the matter, while it may not be mitigating risk that alone changes nothing (no more than a person being attacked on the walk home alone is there fault). I can't help but get the hint of victim blaming here.

Yes he was entirely at fault.
Yes it was utterly idiotic.
Yes it was grossly offensive & humiliating to the individual in question.
Yes it is deserving of some form of punishment/penalty.

But I don't think he deserves to be on the sex offenders register, & neither do I think he deserves nine months in prison.

She didn't ask to be touched by his penis and against her will he did it anyway so yeah that counts as a sex crime so he got everything he deserved.

its in my area and i been to some weird partys but.. it aint really acceptable is it ?

if you have been to these kind of partys something always goes off .



9 months he wont do it again or will he or he will and become even worse and a criminal cause of what he lost. i guess its how he deals with it now.

This is what I think. I am also amazed at the amount of people who think that for something to have a sexual component then sexual stimulation or gratification must occur.
 
9 months in jail seems just, but I'm confused about the sex offenders register part. Do you ever get removed from it? It seems that for a crime like this, being labelled for the rest of your life as a sexual menace may be over the top.

Slapping your penis in the face of a woman as she slept and recording it... What did he think was going to happen? :confused:

Pranks are stupid. Pranks involving your penis are even more stupid. It's not hard to see where it was going and if you're that stupid (and creepy) that you think it's a good idea then I'm pretty glad that you've ruined your career.
