Exceeds marked bay area - really?

It's bad parking but I'd still be a bit miffed to get a ticket for it. It's not really affecting anyone at all and if you'd parked it 'properly' in the bay it'd likely have still been sticking out.

Joys of owning a big car?

Other cars in the spaces behind the entitled parker aren't a defence against loss imo, because bigger cars would have been prevented from using those spaces and may have had to go elsewhere (not sure what happens to the earnings argument in a free car park!).
This is the difference between "actual loss" and "no actual loss". Hypothetical losses are not losses. Much the same as if you have a 'near miss' on the roads, you can't sue the other person for what damage might have been done had you collided.

Alternatively, a functioning brain performs the same job.

True, but brains often fail.

It's an easy mistake to make, without this feature on my 5 series:

https://www.youtube.com/watch?v=HkNIXDcMnOk

I'd park like a retard on a daily basis. It's awesome for seeing how in the lines you are. Shame the video doesn't show actual parking with lines, it's perfect with these cameras.

That's almost identical to what we have on our Infiniti. Makes my life easier.

Sure, bigger cars may be excluded from them spaces, and have to go elsewhere, but the spaces were still filled.

Exactly.

The total potential revenue flow of the car park has been reduced because only small cars can park behind Mr. arse-out, so if a small car left a space it would be empty for longer because it would require another small car to fill it. So revenue generation (were it a factor) would be impacted.

Imagine half of all the spaces could only fit small cars because the other half were full of people that can't use their mirrors. Would there be an impact then? Same principle taken to extreme to demonstrate the point.

This is the difference between "actual loss" and "no actual loss". Hypothetical losses are not losses. Much the same as if you have a 'near miss' on the roads, you can't sue the other person for what damage might have been done had you collided.

Thanks for explaining the difference between actual and hypothetical, but the point is that if no actual loss is sufferable because it's a free car park and if actual loss must have happened in order to successfully penalise a terrible parker, then what recourse do the owners have against entitled parking?

Look at the pepipoo forums. Basically there are certain rules these guys need to follow ie it was a loss of earnings etc.

Please post there and don't let these scoundrels get away with it. If you've already paid then that isn't a great start however they may be able to help!

Thanks, I got a snot-o-gram template from the moneysavingexpert website, sent it on 14/11/14, still awaiting their reply. I think the fact that they pictured cars parked in all the surrounding spaces and were basing their fine on lost revenue should work in my favour.

It doesn't matter either way, they can only try and claim an amount they can prove you cost them, which even in an expensive car park is still nowhere near the amount they're trying to invoice you for.

They've got nothing going in their favour really.

HAHAHA how selfish are you mate?
What if another estate car wanted to park where the Seat is? Do you have any consideration for the front of his car or do you honestly think you can eat his space because you have a BMW?

Well as the spaces are too small to fit his estate in it's unlikely the opposite space can accommodate one so your point is pretty moot.

Is there a time limit that they have to abide by as well?

I would have expected them to have replied by now? Unless they've decided they've got no leg to stand on and not bother responding. Either way there must still be a cut off period that they have to respond by, so they can't come back in a few months time still demanding the fine.

Re: Parking Charge Notice Number XXXXXX (Vehicle: OY64OVV)
Site: Station Road, Didcot Issue date: 01/10/2014

Dear Sir/Madam,

Further to your email of appeal received on 17/11/2014 regarding the above parking charge. I have now had the opportunity to review this case and my findings are below.

Having considered the content of your letter we are prepared on this occasion, as a goodwill gesture, to cancel this parking charge notice.
However, please be aware that this charge was issued correctly as you we exceeding the marked bay area and any future correctly issued parking charge notices will not be cancelled.

Excellent, I notice that they haven't mentioned the loss of earnings which I believe is why they can't proceed further due to the fact that no loss has occurred. But that doesn't stop them from trying to say they've done me a favour!

Yeah, it's all par for the course. Telling you they are doing you a favour out of the goodness of their hearts, don't expect to get away with it again.

They can hardly say, "oops, we were trying to level an illegal fine where no losses occurred, but it turns out you're not some ignorant mark who doesn't know any better."

Better not to get caught out next time, because you don't want to be a test case they try and push through while you hope to get a good magistrate who understands what's going on.

I read somewhere that 2/3rds of people actually pay these parking invoices. Crazy.
