This all seems abit harsh for doing 94mph. Thought it was not anymore than 3 points and a fine if its less than the 100mph+?
Op how could u not see a big van parked up with a camera pointing out? :p

If caught by a camera the thresholds are 0-25 over the limit for points and fine and 26 or more for a court appearance.

If stopped by a police car then 0-15,16-25 and then 26 or more, plus they will have an opinion on how dangerously you were driving.
 
You need to speak to the Central Ticket Office for the force that issued the ticket and find out what's going on. It looks like they may have never received/lost your licence or there is some sort of administrative error here.

They should withdraw the summons once someone has a look at it.

Sounds like an admin error. However, you should have really been on top of you licence. I know the DVLA work slowly, but not even they take over 4 months to return a piece of paper.

Get your dates and evidence that you've paid it to hand, phone the ticket office, get them to withdraw summons. I'd also call the court also to let them know what's happening as sometimes the two don't do as much talking as they should do.
 
I think the threshold for banning is 50% over the speed limit. This was what my solicitor told me when I had to go into court when I was caught doing 89 in a 60 (so was properly border line). Luckily my solicitor knew the PF, and managed to "plead" it down to 85, thus only 5 points and £400 fine.

I'm thinking your solicitor doesn't know all that much then.

A) There is no threshold to banning. There is a only Magistrate and his prerogative.

B) You can't "plead" down speeding. You were caught at a speed. You can't just "change" the speed you were caught at and that doesn't necessarily effect your sentence anyway - it doesn't work like that. Plea bargaining is used mostly at Crown courts to save prosecution time and effort. Your solicitor may have presented mitigation to effect your sentencing. You can be caught at 96 in a 70mph and get a really hefty sentence, or you can be caught at 105mph and get a lesser sentence.
 
Thanks guys feeling more relaxed now, clearly an admin error I panicked as I've not been able to got hold anyone due to them closing at 4pm.

Roll on Tuesday and see what they say ........

The amount of poops who have beeped at me or flashed to get out of the way is SO FUNNY!

I wish i had a sign that says the Speed limit is 70MPh so i could flash it at them
 
Lies. As if that was true you would have got 6 points not 3 as they Double the points in your first year

That's also a relatively recent thing...never the case when I started driving (and they don't "double your points", you are only allowed to get 6 before losing your license).

I have ultimate respect for my solicitor and his knowledge. It's not the first time he has done well for me with driving offences.

Sure, there is no set threshold, but, certainly for my area at least, and I would imagine others, there is likely to be a percentage game in play. I mean, saying 26 mph over is fine and well, but I would expect a ban long before I was doing 56 in a 30 for example.

As for the pleading it down business, you can say that all you want, but it happened right in front of me, in front of the whole court. The PF read out the charge, my solicitor suggested a lesser speed, it was accepted, and I was convicted based upon that speed. My fine was obviously based upon my income though.

Either way, I ended up with 5 points instead of the possibility of walking home. I was happy, and my solicitor earned his money. Not for the first time either.
 
Any links to the ACPO speeding guidelines on acpo.police.uk seem to no longer work, but I remember it saying guidance for when to prosecute was 50mph+ in a 30 up to 94mph+ in a 70.

Of course any area or police officer can ignore that guidance and do their own thing, but anything above that guideline I'd definitely expect to be going to court. Being caught at 94mph is definitely right on the edge of that so be glad you weren't caught a couple mph faster :p

Hopefully it doesn't go any further if you have evidence of payment for accepting the points and fine.

You can challenge that and and tbh it will drop in court. TBH I would waste time and they will quit. Its BASIC SCARE tactics. Sadly you paid so there is a connection to your 'CRIME'.....You have fallen for the tactic. Live and learn. :D BTW the speed in mid day traffic....You aint gonna get any further.

Deliberately annoying other drivers for your amusement (whilst yourself speeding) is so much more responsible.

Just to add, I was clocked at 103 on the M1 in 2008. I got a 30 day ban and £75 fine! Whatever you do, don't drove to the Court house!

ACPO guidelines for court summons (not banning, just summons) is 26mph over the limit for all limits except 20mph and 30mph, which are 15 and 20 over respectively.

Guidance for when to issue a fixed penalty with no court summons is the famous 10%+2 rule.

That is all guidance though, so introduce the factor of an actual police officer pulling you over and suddenly you might find yourself in a position to be nice or be a bell end and see some flexibility in those numbers.

Speed kills!! and don't be one of those who says I know how to drive ect....
only takes something like a animal to run out in front and not being able to counter it in time! Not to mention any passengers or other road users you will hurt..
