Cheated out of redunancy

Wow them links totally change matters.

No wonder they wouldnt offer you a redundancy.

The lateness record is unbelievable to be honest.

eh? That is more reason to offer it to him first time round... though it is in theory to make a role redundant in reality people will use it to get rid of employees they no longer want

Doesn't sounds like constructive dismissal to me. If they're paying out so much money in the past, I highly doubt they were just waiting for you to hand your notice in...

Just suck it up and move on, it's just unfortunate timing.

In my last job I resigned for another role. 6 weeks after I'd finished my old place rang up, said they had targets to meet for a Voluntary Redundancy drive and offered me a full VR payment.
If they don't meet their VR target (if they have one) they may be in touch in the future...

There's no way the timing is coincidence. If it were a group of people caught foul by this they would have a defense but as they are discriminating against a single employee it's a different matter.
 
Is the while point in offering a voluntary redundancy package not to encourage or entice people who don't want to leave, to leave?
Can't see why you would offer a package to someone that is already happy to leave and working their notice period?!
Unfortunate timing but I don't think its discrimination or cheating the op out of anything... Offer wasn't on the table when notice was handed in

Well that's pretty obvious, everyone but him who applied for voluntary redundancy got it, they said nobody else could do his job. Then when he handed his notice in they had somebody else do his job and offered out more redundancies.

Pretty clear cut lol.

Just unlucky timing.

I don't see how someone leaving, who also wants to leave and has found work elsewhere can complain about not being offered money to leave.

Why people think they deserve every penny they can get their hands on?

I have a story about redundancy, I used to work for "Bank" in the IT Dept, but orrignaly worked for Fujitsu before being Tupe across to the "so called bank" and was there for about 4.5 years in total and walked away with 11k. Now I'm no rocket scientist but I'm 100% they paid me the incorrect amount! It was meant to be a lot lower! But I asked no questions and heard no lies! I just kept my mouth shut and almost 6 years down the line, I've not one word from them hahaha!
 
I've quit jobs before redundancy payment in the past and still received it.

It depends on your employer but surely you spoke to HR yourself and confirmed you would still be eligible before you handed in your notice?

I don't understand how they can offer redundancy and then offer it again nullifying previous agreements? that doesn't make any sense to me.

Not that simple:

  1. He applied for voluntary redundancy - it was denied.
  2. He then tendered his resignation and it was accepted.

Some of the comments on here from our resident internet solicitors are ****ing hilarious :D

The OP was lucky he wasn't sacked years ago and feels aggrieved that he wasn't given redundancy and a pat on the head!

He lives in a fantasy world as do a number of our posters.
 
The VR was not based on past performance. Even if it was then surely the poor performance based on the previous threads should have encouraged VR not discouraged it? at the time of the first VR they had no idea that i was planning on leaving.
