Brother receives letter from local MP

I have never registered to vote and not had any problems yet. In your case just say he doesn't live there any more? Maybe I get away with it because I live alone or its just council specific.

I still struggle to understand why it is mandatory to register to vote even if you are not voting.
 
Send them a NIP saying you are going to sue them for twice the amount they are "demanding" from you, and quote the Bill of rights.

Bill of Rights act.
Grants of Forfeitures.
That all Grants and Promises of Fines and Forfeitures of particular persons before Conviction are illegall and void.

A word of caution.

The law under which electoral registration is run changed recently. The old system of household registration where one person was designated responsible for registering everyone at the house has gone, and is replaced by individual responsibility where each and every one of us, individually, is required to register unless you fit one of the statutory exemptions.

Until recently, by which I mean late 2013 if memory serves, you could be fined, and up to £1000, but it required prosecution, a court case and gave you a criminal record. So, needless to say, there weren't many prosecutions .... if any.

However, now, you can be issued what amounts to a fixed penalty notice, like parking ticket. It is much, much less onerous a process on the courts, and my bet is that while going through a whole prosecution process was a big deterrent to the authorities, they will be far more proactive about handing out £80 tickets.

My point is, just because they didn't bother chasing in the past doesn't mean, under the new far easier system, that they won't in the future.

As for those recommending the OP fill in and sign the registration for his brother, my advice would be to look up the penalties for electoral fraud before doing that. The declaration is a legal form and if they catch you fraudulently completing someone else's form .... :(

A better bet would be to contact the council's electoral officer, explain the situation and drop it in their lap.
 
Just explain to your brother that the law has changed and he needs to fill the form out each time it comes through. Doesn't matter which address he states if it's his address at that time. It's their problem if it becomes out of date for people who move, which is why they send them out more frequently than the other obligation of completing the census each time that comes around. Be sure to deal with the council directly though rather than responding to that letter as it's a prime target for a scam.
 
Is it not just easier to register him than go through all the agro of complaining and finding reasons why he can't register? You can do it online can you not, takes 2 mins?
 
When you're of a social disposition what is the most simplest of tasks to most can seem impossible.

A lot of people do not understand this (I'm not pointing the finger at anyone specifically here) but trust me it's incredibly frustrating to be in his brothers position.

In all fairness, there are probably more effective ways to suggest to someone that you're a nutjob.
 
Brother receives letter from local MP. To the house where he used to live purporting to be from his local MP indicating the Government has recently introduced an eighty pound fine for not registering to vote/not being on the electoral register.

It carries the House of Commons stamp and the name of his local MP.

Do I understand this to mean that the local MP is just notifying your brother that he should register and could be fined or is he actually notifying him that he hasn't registered and will be fined?

I find if strange that a MP would inform non registered people that they have been fined, NOT exactly a way to encourage people to vote for his party.
 
I had a red final warning letter on the weekend to fill in and register as not done so for a few years. Letter was hand delivered too! I did fill it in and sent it yesterday.

We should be able to opt out of filling in these forms if we want. We shouldnt be forced to fill them in etc.

I agree on opting out. After all, it's a "voting" register, so if you've already decided you aren't going to vote, why register? Unless, of course, big brother uses the register for things other than determining voting eligibility. Which, of course, it does.

On the subject of "other things", did you notice the opt-out bit for the open register? If you didn't, it's a source of data for junk mailers, etc.
 
I don't understand why you need to register to vote if you have no intention of voting. I'm registered, don't know when but have never voted. I do however constantly receive phone calls and junk mail especially around election time.

Because the electoral register isn't just used for voting. It's the most up to date record of who lives where that the gov has.
 
I would have done. But I don't know if me stating he was living at where he does (at the moment) or mine or my sister's would have any legal bearing on any of his other dealings, say for example his Esa? It's not so simple. Thanks :rolleyes:

it is pretty simple, he presumably has an address for ESA and for his bank... he/you should use that

if he's going to be stubborn and refuse to do it then he gets an 80 fine, that is up to him

C) I pay council tax the council knows where I live.

Maybe at some point it made sense, these days they just want to sell the data on and make some money. It's just another pointless database.

A) For a myriad of reasons. It's quite obvious that a council would want to know who lives in the area they control.
B) Census is done every 10 years, LAs need much more up to date data than that.
C) Not everyone over the age of 18 pays council tax.
