CEX: how do you actually get a refund/repair/replacement?

I've heard people say their water damage triggers have gone off when the phone was exposed to a little bit of moisture. i.e sweating at the gym with your phone in your pocket
 
Vodafone pulled the water damage trick on me even though it was never wet and the broken switch was the actual issue with it - i.e. even if it had got wet it had nothing to do with the fault.

Fixed it myself, after they even rejected the analysis of the "water staining" showed it was flux.

Been with orange ever since so they've lost me as a customer for over a decade now...
 
The liquid damage marker is next to the battery contact point on a G4 (a small white sticker) is it red?

Also because its been less than 6 months its up to the retailer to prove the fault was not present at the time of purchase (you don't have to prove it was). They are obligated to repair or replace the item and if neither of these two options are possible, a full refund. Start quoting consumer credit act paragraphs at them and threaten with small claims if they still don't back down.

I wouldn't bother humouring them any further, just do this (although it's the Consumer Rights Act, not Credit):

Dear Cex

The Consumer Rights Act 2015 states that goods must be "as described" and "of satisfactory quality".

In addition, Section 19, Subsection 14* of the Consumer Rights Act states that:

"[...]goods which do not conform to the contract at any time within the period of six months beginning with the day on which the goods were delivered to the consumer must be taken not to have conformed to it on that day."

As this fault has appeared within the 6 months period, the obligation lies with you as the supplier to prove that any alleged water damage was not present at the point the goods were supplied.

Further to this, the water ingress indicator on the phone does not actually appear to be indicating the ingress of water as you have claimed.

Due to these points I insist on exercising my consumer rights by requiring a repair or replacement within a reasonable time and without significant inconvenience to myself. If this is not possible, I shall be returning the faulty device for a full refund.

If this matter is still not resolved, I shall have no choice but to further pursue it through legal avenues.

Used to use them on the odd occasion when I wanted to get rid of old hardware. Wouldn't now, though. The pricing not differentiating between various models is my biggest gripe.
 
Do these people even talk to one another? I sent them a Facebook message (as it's the only way to get a reply seemingly) regarding the Consumer Rights Act and I got this reply:

Hi Alec,

I'm afraid we have not received this order. Can I request you to reply to the same email with teh tracking number used to post the phone back.

So I replied:

You have already sent me an email saying you returned this order to me after I returned it because the phone was water damaged

And then they say:

Hey Alec,

I can see that our team is already handling this for you. Please be assured that they shall contact you once their investigation is completed.

The last email I sent was:

You cannot provide any proof because you don't have any. The phone is not water damaged. The indicator on the inside of the phone is white indicating no water damage inside the phone.

I would like to send the phone back to you and have it repaired properly this time please.

That was on the 6th so I'll wait a few days for a reply.
 
There's your problem, you went drastically wrong at the first step. Never, under any circumstances, give that scum your patronage and money.

they paid £35 for my steam controller meaning I only lost 4 + shipping not a bad way of getting money out of the steam account and back into my wallet. I wouldn't buy anything though.

I'd be wary of sending them anything, a mate sent two 580's to them a while back for testing prior to trade in he got one back with a jammed fan and the other was completely dead, they claimed they were liked this in arrival....,

I requested a refund by writing this on the inside of the parcel, on the printed invoice.

Why did you ask for a refund when you wanted a repair/replacement? :o

Also what colour is the dot above the sd slot?
