Section 21 notice.

A friend has just had a section 21 notice through the post.

Its her first time living on her own and its really shook her up as she thought she was being evicted.

Now i've calmed her down, but, can anyone give any insight, it was my understanding that these should only be sent if the landlord wants someone out, not sent as part of an ongoing tenancy?

Hmm I'm no expert but I'm not sure that is quite how section 21 is supposed to be used - it appears like they are using it so as to reserve the ability to get rid of someone on short noticed after that date :S
 
Reading comprehension skills are generally advisable.
It says everything she needs to know on the letter.

A) shes not being evicted
B) Its a process the landlord is doing , to cover his back no doubt because hes had issues in the past
C) she doesnt have to leave now but does have to understand that she have 2 months to do so. The landlord probs wants to sell up .

Its really no big deal, the landlord should have maybe let her know to expect it beforehand though.

Yea this is what raised my eyebrow.
 
I can understand kind of what they are doing but it seems to me they are trying to use it to expedite the process if they find a need to get rid of someone in a manner that I don't think it is supposed to be used.

Pretty standard stuff. A lot of agencies do it, for right or wrong.

Though wouldn't surprise me I don't recall any of my previous landlords doing it like that.
 
She needs to leave by July end of story.

Nope, I had many of these on rented property, doesn't mean the landlord wants you out by then. They're just covering their back.
In most cases you can still go to rolling month or negotiate a longer term.
There are occasions when they'll want you out at the end of the original agreement but they normally tell you this.

How do you or her still not have a grasp of this situation.
She needs to prepare to receive a letter of leave in July.

Read the preface sheet again - they seem to be reserving the right to boot her out any time after 7/7 but not actually telling her she needs to leave unless they correspond in writing at a later date.

If it came to court then she'd have 2 months from when they corresponded in writing not 7/7 but they seem to be trying to side step that.
 
Once it's a rolling contract they have that right either way this just seems like a strange thing to send out.
 
The only thing I would query is the wording and date of section 2, because it looks like they messed something up there. I wouldnt be surprised if this process was detailed in her original contract..

I've heard of cases where landlords issue a section 21 at the start of a tenancy - doesn't necessarily mean anything, although it does seem strange to issue one midway through for no apparent reason - how long has she been living there?

It's fine, meaningless and just ignore it.
Again it's pretty standard these days and often issued within days of renting.

Its because you have to issue it at least two months in advance, which is what they done. Although I've always been issued it at start.
 
Was the letter removed from the OP? I feel like I am missing something :confused:

I've never heard of a section 21 being issued during a tenancy (or at the start, eh?), I thought that was the beginning of the process to evict someone :confused:

A quick Google suggests the landlord would still need to give 2 months notice separate to the s21, so what do they gain by issuing it at the start of a tenancy? :confused:
 
If I'm understanding this correctly, they're initiating eviction proceedings in advance, just in case they want to later? Sort of like putting a gun to someone's head but holding off on pulling the trigger?

As a tenant that's what it sounds like. I'd have serious misgivings about a landlord if they wanted me to sign a s21 with my tenancy contract. I'd probably walk away.
