It's wrong, the person should be the sex/gender or whatever you believe them to be/whatever they appear to be or said they were.

Yeah this case was always weird. There would just be so many giveaways that i can't understand how any normal person wouldn't notice a lot of things wrong in the situationThis whole case stinks to high heaven!
Points of scepticism....
1. How did she heat up the object to internal body temperature so her so called victim did not clue up it was a little cold. It not easy to heat something to 30c +!
2. The smell, men and women smell totally different.
3. Why did victim not want to see a little or chew on a little ****!
4. The voice.
5. The lack of Addams apple.
The list is endless and if you believe the victim you will believe anything.![]()

When it concerns sex/gender there can be no doubt.
In context if I started talking to a girl and the girl was transgender, she should say so before anything became physical, anything else I would regard as a gross attack against who I am and at least sexual assault if a physical encounter had taken place.
So if a lady who used to be a man is so passing, that you can't tell even after sex with her, you are that insecure about your attraction to biological/genetic gender, you think it should be a crime? If you can't tell after you've had sex with her, isn't it at that stage you think "ok she used to be a guy but how she's female and it doesn't matter what the situation down there was 5 years ago"?
No but there are psychological factors also.
What if you eventually wanted to have kids with this person? Only to find out they physically can't because they used to be male? Granted there are other means of having kids but you get the jist.

Precisely, a lot of people count things like having biological children with their partner as a life goal. Imagine how much of a waste and a betrayal your relationship would feel like if you think that you have not worked towards that moment.
Just to throw it out there, what about infertile women (or men)? Do they have a duty to declare? Before or after you first do the sex with them?
So in the context of the trans with a straight bloke. If they are looking for a bit of fun, then it has to be declared as the straight blokes idea of that is hooking up with a biological female.
I'd say if it's just a bit of fun then the bloke is looking for boobs and fanny, if the trans person is post op then why would they declare anything?

in the case of a tranny you're not pretending to be a specific person but are pretending to be a person you're not in order to have sex with someone who wouldn't ordinarily consent
If I tell a girl I'm an airline pilot with a suitably dreamy masculine name (you pick), is it rape if we bone on that basis? What if really I'm a government appointed Badger culler, and she's a rampant vegan?never thought you'd be a rape apologist
say a girl starts dating a guy who has an identical twin she doesn't know about, he doesn't actually care much about her so let's his twin go round and have a fo one night pretending to be him... rape by deception
