Spoke to the house builder who are looking into it. Went round to tell him and was fibbed off by his wife as he's tucking into his dinner. Didn't have a spare 30 seconds. Seriously.

I guess i can see his concern too. But if the OP is having his carpenter put up a gate, he could just as easily put a new fence on the neighbours side of the gap.
The neighbour can't dictate what you wish to do with your half of the fence.

I think this is what it's all about. The fact that he can't have what he wants though he wasn't going to anyway if it was overhanging so he's tough out of luck.

A lot of rusty nails exposed would suggest long term damage!
My parents neighbours (who keep horses in a field at the back and are total menace with them) out in the sticks went mental one bonfire night when we were setting off fireworks. Our response was to set off some massive 4 foot high rocket we found, while she was in the middle of complaining. I thought she was going to die of anger.

Setting off fireworks when your neigbours have horses is pretty dumb and inconsiderate, but hey ho.
It amazes me how neighbours allow petty matters to dominate their lives. We all have to get along, otherwise it's just a big pain and wasted effort in the long term.
I'm lucky, I have good relations with all my neighbours. I regularly cut the grass for the old girl next door. I voluntarily patched the other neighbours fence this year. I've filled a pothole in our shared driveway at no cost to them but myself. Of course, I walk on water in their eyes now but it's important to me that we maintain a good community in our little corner of the world. It certainly means I don't have frosty neighbours come shouting at me and making demands of me like op has.
