Debit Card Charge Back Query

Hi All,

Just wondering if anyone could help with a query about a charge back.

My partner has booked some tickets with Monarch for a surprise holiday next year. Looking at the state of the company we're just wanting to know where we stand in regards to getting our money back.

The issue we have is that they were purchased on a debit card as she doesn't have a CC (never needed one) and she didn't go into her overdraft so a section 75 is out of the question. I've checked with our bank and our travel insurance doesn't cover scenarios like this either so this just leaves a charge back.

My main query is that Monarch as an airline have a no refund policy so I was just wondering what would happen if we tried doing a charge back? The tickets were only booked 2 weeks ago so we're well within the time frame for a charge back.

Any help would be appreciated!

Cheers

At the moment the company is still operating right? In which case you have no grounds for a chargeback AFAIK.

Doesn't the ATOL thing kick in?

Yeah if the company goes bust but they are not yet.

On a side note, this is the reason why you should always have a credit card for high value purchases. Regardless if you want a credit card or not. When it comes to situations like this then you have nothing to worry about, it's basically free insurance.

You probably won't be able to convince your bank to issue a chargeback, especially given the only grounds you have are that you are worried about what happens with the airline.
If you did, I'd imagine they will chase you for non-payment.

why worry about it, atm they are still in business. if they go bust you will be covered by the chargeback (120 days, plenty of time).
However reading some news articles this is a yearly thing with monarch and so far they have survived.

edit - its 120 days from the flight date. So even more reason not to worry

Collapsed company

You book a flight or trip with a firm that then goes bust before you take it. The deadline starts from the date the flight was due to take off or the holiday to start.

Don't believe that a bank has to offer the protection on a debit card that they do on a credit card, some do as goodwill but they don't have to.

They have to, it's part of visa and MasterCard they sign up to. What you don't get is the section 75 protection.

I think your only choice in this situation is to now trigger a charge back with your bank.

However as the company is now in administration , you're effectively at the bottom of the list for getting your money back. Secured creditors will take their chunk, then i believe the staff get their share for redundancy payments etc. Anything left over is then available for customers to apply for a refund, along with other things.

I hope the flights weren't too expensive.

We've got £168 on my debit card for a trip in Dec and then £1200 for a group booking in Oct next year. Shall have to wait and see :-\

Crap to hear, guess this has to be taken as lesson for future reference when booking a debit card. Hope you get a refund hassle free.

People are irrationally afraid of credit cards. And then you see exactly what happens to op. Doesn't make sense to me.

and what is that, he applies for a chargeback through visa or mastercard and he gets his money back.
People have an irrational idea about debit providing no protection and then when they find out they have protection, move to it'll be ignored nd you wont get your money back.

ATOL only applies to package holidays monarch removed the flights only protection last year so if you booked the flights and accommodation with them it will be through Monarch Holidays Ltd this has atol protection but if it is just the flight no protection .

Flights booked directly with Monarch Airlines from 15 December 2016 onward
Customers with these bookings are not ATOL protected and are not entitled to make a claim to the CAA. You are advised to contact your card issuer, insurer or PayPal for advice on how to claim a refund

I can think of an instance where she did need one that involved buying aeroplane tickets. Perhaps there are others? Get a credit card.

And then you end up paying a surcharge, or the company does. I've had credit cards declined "sorry debit cards only" for this reason. Too much of it about. Got a £7000 credit limit on my card and I can't spend that amount in one go anywhere! Even the car dealership wasn't having it.
