The documents show that the three countries propose elevating fighting copyright violations to a special status – above combating terrorism, child abuse and serious online crime. This would put our fundamental rights on the line, and create legal chaos for service providers in Europe.

I wonder how many greasy palms there were after that arrangement...

But it's all a waste of time, they are powerless to monitor people on VPNs and they can't do anything about content hosted outside of the country.

If e.g. the UK decides not to give a ****. Suddenly the hosting business is booming here and it's untouchable. Just like it already is in Russia and Asia :p

Sorry but you are wrong. Just because someone's on a VPN doesn't mean the connections AFTER the endpoint cant be monitored. It's only encrypted between you and the endpoint, all traffic from endpoint to server is 100% monitor-able.

As for the second point, of course they can do things about content outside the country, not only have governmental forces seized ALL significant IXPs, they have full data sharing arrangements with overseas law enforcement agencies.

Couldn't someone just use a VPN then Tor browser? It would certainly make it difficult but not impossible I expect. I very much doubt people are going to get traced for downloading a leak of the new Paddington bear film :D More likely they are looking for mass distributors of content or those selling copyright material.

It seems irrelevant to the French, Spanish and Portuguese that the European Court has ruledthat it is unacceptable to impose a filtering obligation on providers if that filtering:

  • is of all electronic communications passing via its services; (as in this case)
  • applies indiscriminately to all its customers; (as proposed in this case)
  • is done as a preventive measure; (as proposed in this case)
  • is done exclusively at the provider’s expense; (as proposed in this case ) and
  • is done for an unlimited period; (as proposed in this case)

Oh so EU courts are against such such terrible policies? Dayyyyyymn.

Such awful policies are actually more likely to come into force in the UK being outside of the EU than from being a member.

But that is beyond what the ISPs are able to do. Also many VPN providers don't keep logs, so you would only be able to follow it as far back as the proxy which 1000s of people could be using. You'd get nothing on a specific user.
