Advice Required - Relentless Debt Collector

He's hardly being obtuse, and ignoring communications from a company which will potentially take you to court for money they claim you owe them is a great way to end up with a CCJ

Come off it, obviously my statement extends to ignoring letters as well as the emails.

Ignoring communications from a company cannot land you with a CCJ. If they actually intended to take him to court they would file a claim with the county court which he could respond to accordingly in a proper official manner, arguing over email for 4 years accomplishes nothing other than wasting his time.

I've just had the latest debt company email me to say they've been instructed by their client to suspend all recovery activity as the debt is in dispute. I can assure you it works better than leaving them to escalate without challenge.

I'm also expecting documentation from SSE proving the debt is nil, which is coming this week. Upon receipt of that, I'll be contacting the Ombudsman.

I won't be sticking my head in the sand, but thanks for the advice all the same.

From personal experience I can tell you that ignoring a dca like this and making one single response to a county court claim proving you don't owe a debt once and for all is far more expedient than spending 4 years writing emails.

I am not suggesting sticking your head in the sand and pretending that there isn't an issue, I am saying that there are far less tiresome ways of resolving the issue. You've refuted their claim and given them evidence. Now they can either continue sending you emails and letters etc or make a county court claim which you can easily refute in a legal manner.

Hopefully the client's statement will, after all the faff, get them to stop harassing you!

I had to use the Financial Ombudsmen when Egg tried to take me to court via debt collectors back in '05. Shame I'd never had an Egg card (only a paid off loan) as that really screwed up their case against me :D but until the FO stepped in Egg weren't admitting their mistake so the debt collector just kept coming back at me.
 
What would be the specific violation? I could add it to my complaint to Ombudsman.
Your data may not be being used in accordance with some of the data protection principles in the link in my post. It may be worth having a chat with the ICO to get their opinion.
 
Got another update by email today. This one is pretty conclusive as far as the debt goes. I really feel like I've got somewhere now.

Thank you for your email to our Head of Customer Service regarding the bills and reminders you’ve received for the supply of **********. I’m truly sorry for the time this complaint has taken to resolve and for any upset or inconvenience cause by these bills.

I see that when you spoke to us in December 2014 we offered to clear the standing charges and there would be no usage billed for as the property was empty. We had also received confirmation of sale of property from Munro Lidell Solicitors to confirm sale accepted on 2 April 2013.

Unfortunately, at this time the gas account wasn’t updated. I’ve ensured this has been removed from the external agency’s accounts and transferred to the liable occupier. I’m sorry this wasn’t done at the same time and I hope I’ve been able to resolve this for you.

Please let me know if I can be of any assistance going forward.
 
Well that was nice of them. At least they've admitted the mistake and apologised.

I notice there was no mention of compensation for the stress and time you've had to waste sorting it out though
 
I'd totally take them to task for all of this, they probably have a case to answer for regarding the harassment and time they've wasted.

I had a hell of time with a mobile contract screwup a few years ago (nothing compared to you, but debt collectors did call a bunch of times which isn't fun, I also got a default on my credit file) when I won the appeal I did get 6 months free service and a bunch of stuff including some compensation, so it pays to persist.

Please don't just let it drop now and consider the "let off" a win. They need some kind of repercussion. If they don't, they won't improve their standards.
 
First of all, well done OP for getting a resolution finally!

Stick with it - you never know, could totally end up being worth the effort!

Whilst I agree that the OP should definitely take the case to the ombudsman as there is a clear systems failure at play here which needs to be rectified, my question to you would be: what exactly does the OP have to gain from going through this process? They can’t get the time back, I highly doubt there will be any financial gain and that leaves a warm fuzzy feeling that you’ve got the ombudsman on to SSE.
 
Email sent to Ombudsman today - it took me 3 hours to get all the information ready to attach and to compose the email. :mad:

I'll update the thread if the Ombudsman decide to do anything about it.
 
Bit late to reply, but echoing others about pursuing the complaint with the OS. You were originally told that the debt had been cancelled and your account considered final and closed, yet it popped up again. Despite this customer services manager actually doing her job and potentially closing this case once and for all still doesn't give me the feeling that something might still pop up again in a few years.

Also not to mention that if a complaint like this does escalate to a fine of some sorts, it usually forces companies into reviewing policies/procedures to prevent anyone else getting into this mess.
 
Anyone heard of Creditstyle? received a text from them to urgently call them. I don't owe a debt to anyone my guess might be one of my tenants owes money as a while back I received a text from Green Star Energy saying An invoice is overdue. I called greenstar but as they could not tell me which house it was for or the name on the account I forgot about it.
 
Have they offered any form of compensation?

I had a similar issue with BT a number of years ago and even after they resolved it I wouldn't let it go, and the CEO sent me a cheque of just under a grand.
