Idiot Son and 6 points

Hello All

Quick question my son was caught driving while uninsured and with only a provisional license

He has been given 6 points and a fine

So under the new driver rules getting 6 points or more in 1st 2 years means a ban when you receive your full license .

What I'm trying to find out is it best for him to take his test and have his license revoked back to a provisional or can he sit out the 4 years till his provisional license is clean or do they stay on ?

Points on your provisional licence
Any penalty points on your provisional licence that haven’t expired will be carried over to your full licence when you pass your test. However, your licence will be cancelled if you get any further penalty points that take you up to a total of 6 or more within 2 years of passing your driving test.

What I'm taking from that if he takes his test now he will lose his full licence when he receives it and go back to a provisional

So he may as well wait out the 4 years then apply for his full licence when his provisional is clear ??

It is to the rest of us, insured, licensed drivers ;)

Pretty certain that if he passes with 6 points already on his provisional, he has 6 points. Get caught/more points within the 2 year period, and the newly aquired full license goes bye bye.

He has 6 and the link below does say 6 or more

I think get him to ring the DVLA tomorrow only way to be sure

If you read your own link again you will see that when he passes his test he will not immediately lose it, he will only lose it if he gets any further points. The key wording is 'future points', just put him through the test. It's also not difficult to get through 2 years without getting any points, most don't get any in their entire life.

As others have said, have fun with the insurance though, ouch!

His mothers car ..unknown by her or me till we got the phone call

He got a Community Resolution order as we didn't want to press charges so the police were happy with that
 
We've all done stupid things we are not proud of when we were young...

I think the best thing for him to do would be try and pass his test, then just forget about driving until the points have expired.

I feel sorry for you two, I bet this has been a major bit of stress!

Given how the ops son got the points in the first place, twoc'ing mums car, they don't strike me as the kind of person who'll manage 2 years without gaining any more points, quite the opposite tbh.

Yes very stressful as he had just got an apprenticeship as an electrical engineer so he's now fubar for travel
