It doesn't really fall under the "stupid mistake" heading though does it? A stupid mistake is missing a speed limit or other signage. Misjudging an emerge into a road or some other split second decision or oversight. A spur of the moment decision we all get wrong at that age. Getting into and driving a car uninsured and without a license is selfish and reckless, it takes some thinking about. The fact that he was pulled at 2:30 in the morning sounds like it was more of a joy ride with his mates. I assume he also took the car without consent. Sounds like it was deserving of more than just a few points on his license.
see the post i was replying to. i'm not questioning the punishment he's received. i was pointing out that just because he's done it once doesn't automatically mena he's done it before or will do it again.

No worries I take your point, it may well be a one-off. I hope for mum and dads sake it is. What I was getting at is it was hardly a momentary lapse or mistake. Taking your mothers car and taking it out for a jolly without a license or insurance takes a bit of thinking about, even planning. Sounds like a lad who will go far! Probably in someone else's car.;):eek::):):)

Brum is the most awful place I have ever driven.

Unfortunately I have to work there occasionally and drive in to the centre. It's crazy and its not just people in old bangers who drive dodgy, it's people in Mercs/BMW/Audi - all sorts.

I've not driven in central London but it certainly can't be worse.

I learned to drive in Hammersmith, so I thought I knew about terrible driving. At least London is predictably unpredictable! Birmingham is like a different planet! I think part of the problem is that the traffic moves slightly faster in Birmingham with a lot of dual carriageway and multi lane roundabouts right in the city centre which creates some... interesting incidents! At the weekend there is always some very fast German metal being driven very irresponsibly. I have to lay the blame on the city planners a bit though, the A38 tunnels do bring out the inner child/hooligan in even the best drivers. It’s basically like Midnight Club Racing in real life.

If you think driving is bad in Brum, try cycling!!
 
Update He rang the DVLA and he can have a full licence but if even sneezes in the 1st 2 years while in a car he's back to a provisional So I've told him take your test asap and don't drive for 2 years well 4years really till 6 points fall off lol

He was pulled due to the police just doing a random check on the car after spotting two youngish lads driving at 2:30am , His friend has a full licence and was lucky not to be charged with anything at the time

I woke up in the morning and found the "your car has been seized" and a sorry note from him with his house key and he'd packed a suitcase ready to be evicted

Haha, he's been an idiot but clearly, but most of us are at that age. The idea of him needing to go to jail is :rolleyes: . He was showing off to his mate, borrowed his mums car (sure without permission) and drove in the early morning. 6 points seems fair imho.

Haha. The bit where you try and join or leave the A38 in between the tunnels can be tricky. You have about 2 seconds to move into the correct lane - in busy traffic it can be difficult.

What I don't understand is the round abouts which you approach have 3 lanes but maybe only just room for two cars on the actual roundabout. Then I'll hooted at by some white van driver even though there is no space in the lane...

But somehow I barely see any road rage...just everyone drives like ****!

Yup. The police round here use an ultimatum. They either charge the offender with TWOC, or if the owner doesn't want to press charges against the offender they charge the owner with permitting the use of a car without insurance. It's amazing how often they then change their mind!

Surely that's a bit iffy, just because you don't want to press charges doesn't mean you gave any consent, consent can't be given retrospectively surely?

In which case it was taken without the owners consent. Ergo the very definition of TWOC.

Seems simple enough.

1) The keys handed over with consent although it's known the driver is uninsured. Therefore key holder/owner at fault.
OR
2) The keys were taken without consent (i.e. stolen). Therefore its TWOC.

Consent is up to the owner. In this case the owner has ultimately stated his son had consent to drive the car. Case over.

Then the owner should get charged with giving his consent for his car to be driven by someone he knew not to have a licence or insurance, as Dis86 first suggested his local force do.
 
Re the TWOC the police rang and asked if my wife wanted to press charges "no" . He ask had he paid the impound charges etc "yes" in that case we are happy to just issue a community resolution order as its his 1st offense and as no 3rd party property or person was affected we can close the case .

He still has a note on his police file and if an "Enhanced" DBS check is done it will show up
 
Lucky escape.

Though insurance will now be so high he can probably forget about driving for the next 4 years. I think most insurers will just say nope :p
