Bought a car and its shagged.... How should I proceed? Help

Not sure if you would get far based on the condition, but if you can find a copy of the advert then the fact there is no mention of it being an import would certainly help, especially since you have subsequently been lied to about it, but someone more knowledgeable than me is going to be far better placed to advise though!

OP you have bought a crap car from a bent dealer. My advice is reject the car, you have the grounds. Do not waste your time on this, reject it, get the finance cleared down and find a better car.

Go in, tell them your rejecting the car on *take a printout of all the things*.

Ring finance company, tell them the same and that you want to open a section 28 claim, you also are wanting to withdraw from the finance agreement on the basis of *very large printout*

The relevant legislation you can also cite:

Misrepresentation Act 1967

Consumer Rights Act 2015

Breach of Contract

Consumer Credit Act 1974 Section 75

Thank you,

I shall sort this tommorow now.

As above, no matter what happens now: ABORT.

It seems crazy to me that you'd hand over any cash without a careful inspection, let alone on some dodgy import from Africa.

All that said, best of luck sorting it out...

Not sure if there’s any way to check if it’s been clocked (maybe some sort of dealer level scan tool?) but there’s a very high chance it has been as clocking is rife in poorer countries, particularly on higher end cars. If you could prove it had been clocked, that would give you a stronger case.

Regardless, 20k miles on roads like that is the equivalent of 100k+ on UK roads: there’s a reason why so many people in Africa drive Hiluxes and Land Cruisers as modern sports cars just don’t hold up to the abuse.

As others have mentioned, a lot of the paint issues look like evidence of a poor previous repair to me: it could well have been crashed to the extent of a U.K. write off, but bodge repaired with cheap labor. A friend owns a body shop in Mexico and you wouldn’t believe the state of some of the stuff they repair in terms of crash structure / integrity and that’s without any bodging in terms of paint, filler, panels etc. Chances are, if it looks bad on the outside, it’s far worse underneath.

Even if you can’t reject it, I’d get shot of it ASAP even if you end up losing money.

Oh dear, that looks a bit of a state :( Will cost quite a bit of money to get it looking anywhere near decent.

Never ever buy a car having only viewed it at night.

Hope you get a satisfactory outcome.

Great advice, hope OP follows it.

Problem is, it's not really shagged is it? It's just in very poor cosmetic condition.

All the issues are visual and were there for you to spot.

Unless you can prove misrepresentation you don't really have a leg to stand on :(

Which African country are we talking about here? Not all of them are comprised of dirt roads and dodgy backstreet garages. That said, I still wouldn't buy a car imported from the continent, if only because it's not easy to fully verify history.

Thank you for the advice everyone.

The dealer has agreed to unwind the deal, and apologised that the car was not presented as it should have been.
Currently in the process of sorting this out.

Thank you for the advice everyone

Nice result, if you still want one start trawling the BMW approved used site.

Pleased it’s sorted (or soon to be) and I’m sure you’ll check the next one a bit more thoroughly! :)

there is no real world difference between the 28i, 30 and 35.

the E89 Z4 is a much more refined than the E85 so you don't "feel" the difference in power in normal day to day driving.

unless of course you are planning on doing 0-60 at every set of traffic lights you hit.

i take it you have driven all 3 models to testify different?
