Just been given my 1st Section 59 For Going over 3k revs?

I mean, if you're caning round housing estates every Saturday night with a massive exhaust banging away then sure, S59 is perfectly appropriate and probably the correct thing to go with.

But "You accelerated fast up that dual carriageway" doesn't sound so appropriate.

My neighbour has got a VXR Monaro, and the noise it makes on overrun is pretty staggering - every time he leaves the cul de sac it sounds like someone is testing a whoopie cushion through a megaphone. But is it S59-worthy? Nah.
Depends on the DC I suppose.

I know of one that runs through Wolves and you could spank it off the roundabout onto the 40mph DC where you're straight into a residential area.
 
Just saw an A45 AMG go down the road and thought of this thread :D

No pops or bangs were heard, it just accelerated without causing a fuss. There's a time and a place and plenty of countryside to go (legal) hooning about in.
 
As much as I hate the A45 finance special, is this a Motor's forum or Mumsnet? I'm genuinely confused by some of the replies here, some people must be trolling. Bet they would have a breakdown hearing a screamer pipe on full boost.

Regarding the OP its times like that when you need a dash cam & video footage of the stop and the conversation with the officer.
 
Hey, hope everyone is well.

Long story short I was just on the way home from the supermarket, at a set of lights on to a empty dual carriage way I accelerated rapidly to the speed limit (40mph), must have hit 5.5k revs tops.

I cruise down the dual carriage way and notice a police car on my rear, I think nothing of it, 1 roundabout and 500 yards later he pulls me over. He states "I have pulled you over because you were doing 55 in a 40". I wasn't, he then said I was driving in an "antisocial" manner, the car was revving and popping quite a lot. He asked if I had used a race start or had a crackle and pop map, nope to both. He said basically to not go over 3k revs in the future so the car doesn't pop and thus isn't 'antisocial'. He made it out like he was doing me a favour by allowing me to take the section 59 instead of the alleged speeding.

Do I have any comeback from this? How exactly can I be given a section 59 for accelerating on to a empty dual carriage way, all because my exhaust crackles and pops from factory?

Interested to hear thoughts.

Ah Sec 59. A badly written piece of legistlation born in the early 2000s to crack down on cruisers. Heavily abused by many forces, especially North and South Yorkshire.

The abuse of it was so great that some people, myself included, fought back (I got one for literally sitting static in a car park chatting with friends, the complete opposite of anti-social).

I challenged mine and asked for proof that I was "Driving in an anti-social manner". As the officer could not produce such evidence other than his word & I had obtained CCTV from the car park showing me arriving, parking up and not moving till the officer arrived, the warning was revoked.

After about 2008 forces quietly stopped using Sec 59 until recently where it's begun to reappear, mostly because of the rise of pop & bang maps.
 
You assumed I meant I was saying the OP was in the wrong, when in fact I was actually seeking clarification on overall interaction between himself and the officer in question.

What lol seriously such cops should not be on the road, your keeping the world turning transporting stuff and cops are pulling you over because your truck is too loud or fast, how can they do that and be serious.

Wouldn’t mind were it loud or fast but it’s neither - especially not fast @44 tons - you have to work the engine to move that amount of weight but it’s nowhere near as loud as you’d expect a 13.6 litre engine to be....

As you alluded to earlier I think in this case he was either having a bad day or just didn’t like truckers, or just a moron.

Local takeaway owner's son had one on his rented A20. Every night about 10pm he'd go down our road (on a slight hill) blipping throttle and waking my kids.

Silly boy still had leasing company plates on so I dropped them an email. A week later I saw the car being loaded on the back of a transporter.

Top Tip. Don't modify something you don't own...
 
5.5k peak in gear 1 on the upshift. Let off at 40 in second, then shifted up to 5th.

This is surely the key bit - you went from 0 to 40 in an incredibly quick time, in a very loud car. You then lifted off at 40 - but this won't stop you accelerating due to the momentum of the fast start. I'd expect doing 0-40 in 1st and 2nd and then lifting off would put you well over 40 even when changing up to 5th.

From the police officers POV - he was a few cars back and saw someone go from 0 to at least 40+ in the same time it takes most people to get to about 10mph, the car was loud so it will have looked like you were racing / nailing off the line like a yobbo.

I'm not surprised he pulled you over and from there it sounds like your actions and talk got you the S59.

I can't remember the last time I saw someone nail a stupidly loud and fast car from 0mph so I doubt it's a regular occurrence for a marked police car either.

You may not have broken any 'laws' (although if you lifted at 40 you will have broken the speed limit) but you were driving like a bit of a div in a very loud attention seeking car in front of marked police car and then argued with them, I'm not sure what else you expected.
 
It does make me laugh a bit all the people thinking you can have fun on the public roads.
Just book a track day I used to regularly do then when I had fun cars, like £100 open pit lane for the day off season.
Drive cautiously on the roads. Also means your not interested in messing about on the roads as it becomes boring.

I regularly have fun on public roads. You need to go out late though, 11pm at the earliest (around here later than that is preferable).
 
I didn't break the speed limit though. I simply accelerated to the speed limit faster than normal. Hardly a comparable example

First off, I’m as ACAB as they come, so take my post in that context.

You drove from 0-40 in first gear, in a loud car. I don’t think that’s a crime. I do how ever think you failed the “stupid” test.

Why on earth are you driving like that in sight of a police car?!

Call 101 and make a complaint if you genuinely think he’s got nothing on you and you genuinely don’t think you deserve the warning. My guessing his story is going to differ to yours.
