I wonder how they’ve managed to substantiate the allegations against Torode in order to uphold them? Presumably they must be very confident (recording, multiple witness statements, etc?) the allegations are true before publicly stating it and sacking the staff accused?


A BBC spokesperson said: "John Torode has identified himself as having an upheld allegation of using racist language against him.

"This allegation - which involves an extremely offensive racist term being used in the workplace - was investigated and substantiated by the independent investigation led by the law firm, Lewis Silkin.”

No, you don't need to be very confident.

The standard of proof for employment matters is balance of probability. This a world away from criminal proof.

So it could literally be as good as 2 people saying they swear on their mum it happened and 1 person saying nuh uh.

They don't even have to prove it happened.

I did wonder that as it seems like it would be incredibly easy for a couple of folk with a grudge against someone to make an allegation of a “racist” comment.

Somewhat concerning IMO the press are allowed to use words like “substantiated” and “upheld” with regard to an allegation if there’s no proof?

They are substantiating it using proof that's good enough for employment matters and that's all it needs to be.

Would it stand up in a criminal court? It doesn't have to.

Yep, it happens.

It's a bit like the un-written workplace rule of you should never be alone with a female employee. Always have witnesses to fend off any nonsense accusations incase there is a falling out.

Torode can still take them to an employment tribunal or legal defammation, whilst beeb believes it's showing due diligence to govt.

He can try, but IIRC Masterchef is independently produced and if the production company has dealt with the complaint properly and in accordance with HR/best practice he'll have a fun time of it.
I'm fairly sure I read the company/bbc got major independent legal firm (probably one specialising in hr) to look at what had been going on.

DEI is a very commonly used phrase in the UK.
But better to keep the man with constant complaints about inappropriate behaviour is it? Would that be anti woke somehow?
As far as I can see, no one here has suggested that he be reinstated?
I guess we'll see soon enough who they replace the pair with.
 
Im abit confused about the Torode side of this. He says he has no recollection of it, but then the BBC say he acknowledged that it happened?

I then interpret the article to say the 'victim' recalls the slur being said and then he apologized immediately. It should be a non-story really.

Then again the BBC love stories about themselves when maybe it would be netter to report and let it go.

It sounds to me like they're using it as an excuse to not renew his contract, he hasn't really been sacked has he just not renewed.
I think it's all going a bit far, it's getting so sanitised people will be scared of speaking, who knows what in 10 years will be deemed offensive.
Someone says something to me I don't like I just ignore it I don't get all offended. Glad I don't give the BBC any more.

Who knows what Wallace actually did, but you just know he was hired exactly for his from the street no nonsense character, I direct contrast to Tarode, instead of all this they should have just not renewed him as well.
