I purchased an OCZ Agility 3 60GB SSD from Overclockers when it was on offer a couple of months back. It was to put Windows 7 O.S. onto, but as I still have to send my Mobo back to Gigabyte as part of their exchange programme and then got tied up in buying a monitor, I haven't got around to even opening it yet.

With all the reporting of failed OCZ stuff I really do want to just sell it on so I can buy a Crucial or Intel in its place. My questions therefore are, if I sell it on Ebay or Gumtree can I describe it as new, or do I have to describe it as 2nd hand? Must I send my original receipt with the SSD, or will a copy do? If the person who buys it experiences BSODs etc, am I responsible for taking it back? If not, should that person contact Overclockers or OCZ from that point on? Please excuse my ignorance of UK consumer law.

If it's unopened, it's new in my eyes. As for warranty, it's generally not transferable, the buyer wouldn't be able to send the drive back to OcUK. I would imagine it could be sent back to OCZ with proof of purchase though I'm not 100% on that. You wouldn't be required to accept a return as the warranty is not with you as an individual, though if you were to sell on eBay they could file a claim against you for a refund. It's unlikely it would come to that as realistically they could claim off the warranty with OCZ though.

I think that second hand but unused is the best description.
 
I guess it depends on your point of view then. To me, selling something unopened as BNIB would be fine, I've both bought and sold items described as such before with no qualms, knowing that the seller or me was not the first owner. If the item is unopened, to me it's new, but I can see how some wouldn't see it that way.

You have a valid point, however technically speaking the drive is on at least its 3rd or 4th owner.

OEM--->Distributor--->Reseller1---->Reseller2--->End User.

Therefore there is nothing to say that if the items are unopened the last seller couldnt be part of the supply chain as a second or third tier reseller.

The warranty support however is a much more complicated issue and if you are not trading as a reseller with business relationships along the supply chain, then this is the area that puts you at a disadvantage when trying to sell the item as new since you cant offer any returns and/or 14 day consumer act support. On this basis, the most logical thing to do to cover your backside is to sell second hand as "unused" at a lower cost than the item can be bought new.
 
Thanks for your replies, you can see why I'm unsure how to run with this. I'll probably go with what Humour advises, but others please feel free to give an input.

OCZ aren't that fussy about warranty, just send along the original invoice so they can use that for the original purchase date & retailer if it happens to be needed.
 
If you haven't even opened it yet and it is still sealed then it is new.
Here is the description for new items on ebay;
New: A brand-new, unused, unopened and undamaged item in original retail packaging (where packaging is applicable). If the item comes direct from a manufacturer, it may be delivered in non-retail packaging, such as a plain or unprinted box or plastic bag. See the seller's listing for full details.

Just because it's been in your possession for a while dose not make it used imo.
