So as mentioned in the dashcam thread...

  • In lane 1/slow lane in avg speed limit zone, truck in lane 2 didn't see me - came over, I braked and his back tyres skimmed the side of my car as he drifted across.
  • I came to a stop, he drove off but pulled into a lay-by - said he didn't know he'd hit me, but saw traffic slowing etc so pulled over.
  • Swapped details (though he didn't give me his insurer, but said they'd be in touch) it was a huge truck, so got reg and company.
Anyway, I reported to e-sure via their online portal on the Sunday 7th august (it happed Saturday 6th august) as a non fault claim. So far they've heard nothing from his side, which I've been told not to worry. The problem is my insurance renewal ended yesterday and now I'm left with paying a premium due to this accident. I've just phoned his company and left a message "with the person who deals with this" to see if I can speed things up...there were no injuries, I just want it sorted.

So TLDR, does anyone have advice on how else to proceed? Are their any online sites to request dashcam footage for a time/place?
 
In my experience it takes as long as it takes, weeks is nothing (one claim I had ran through two renewals :( ) the whole system isn't setup to be quick or easy to deal with so you just have to suck it up and wait :(

You should really be able to claim from the other driver for the future increase in insurance premiums that result from a non-fault claim, but i'm sure they'd fine a way to claw that back in other ways...
 
I have an unsettled claim 50/50 from March 2020 because both parties haven't recovered what they want yet. I've had to declare non-fault since then and nobody has been interested in compensating the higher cost. Partly COVID has been to blame but it's a fairly simple case (although 50/50 isn't fair, IMO I just wanted it done with). Luckily the cost increase has been negligable for me, less than a tank of fuel, but they don't offer anything on a plate. It'll be another 2 years before I see half my excess back at this rate.
 
We had something similar with an artic driver who just decided to go from lane 1 into my wifes car in lane 2.
The Police had got it on CCTV and said you need to buy her some flowers how she kept her cool and saved you all.
It took two years to get our money back.
 
These things are slow, annoying really considering you have to pay for insurance so just have to suck it up having such poor/slow service. Any other industry were to provide service this poor you would just swap who you use but seems all insurance companies are just as useless as one another because they know they can be.
My car was stolen from my drive back in April and I’m yet to get paid! I phone atleast once a week. Phoned last week and was told “you should have received and email about some more details needs on 2nd July”. Told her I hadn’t, turns out the email had been saved a draft in their system and nothing had been done since!

Worst part is I had phoned atleast half a dozen times in between and she was the first one to mention it.
 
So got an email today saying that the third party dispute the claim and would i be willing to go to court if needed.

Really, really cheeses off.

Assuming based on how you've said the accident went down then you're going to court over it? You say you mentioned it in the dashcam thread so I assume you've got footage. - I'm actually surprised the 3rd part are contesting it if there's clear footage of the incident.

I have no footage, not sure I've said that I have but this issue is precisely why I want a dashcam. The email regarding could is "if needed" but yeah, uncharted for me.

I have said I'd be willing to go to court FYI.

Thought the lorry would've been covered in cams but not heard mention from their side.

Problem is that it is common practice to just deny liability (the insurer) if there is no evidence.

That is why insurers always tell you to never admit liability, even when it is obvious. They want to decide whether to admit liability based on what they get told.

Did you take photos of everything?

Ah my bad, when you said you'd mentioned it in the dashcam thread I'd assumed you had dashcam footage.

As for the HGV yeah I thought most nowadays had dashcam, unless they do and that's why they're pursuing taking it to court.

To be honest I'd figured that they'd give footage now to prevent any further cost/time wasting

It most likely has forward facing cameras and, if it goes anywhere around London, it is mandatory to have near side “blind spot” cameras which most likely would have captured your incident…

Edit: Incidentally, if his trailer hit you and it was heavily loaded, unless he actually saw it happen it’s extremely unlikely he’d have felt and therefore been aware of anything, the fact he pulled over tells me he knew exactly what had happened, you don’t just pull over in a truck because traffic behind you suddenly slows….

I’m not taking sides here but can assure you the blind spots on artics are very large, more than enough to make a large van disappear never mind a car, that does not however excuse the truck driver from being aware of these blind spots and making sure there’s nothing in them before moving over which I’m assuming is what happened here…

I would be hassling the truck operator and their insurance company for footage, it most likely exists!

I tried but no dice

Sorry that was relating to highways. I phoned the company last year and was told I'd be put through to the bloke who deals with this stuff. Got an answer phone...left a message but no callback
