Accident - blame not entirely apparent

Ich haben ein riffen panner!

Thats about all I can remember from German lessons, although my surname may have German origins?

Oh and I menat an + instead of the last + as I am sure you knew ;)



For those who don't understand, German traffic cops use this formula to assign blame in any accident:

Foreigner > woman > man.

Thus is a German man drives into a foreign women, there is absolutely no question that it must be the woman's fault. Etc.

I would say if she was out of the parking bay and stopped it would be her fault. Altough how did the guy not manage to see her, had he just came round a blind corner?
 
If she was stationary then its the other car's fault.

Agreed, if she was stationery and someone hit her then I don't see how this could be her fault (assuming she didn't pull out and then stop right in front of someone which going by the op wasn't the case)? If anything it shows a complete lack of awareness on the part of the person who hit her.

Of course without witnesses this would be hard to prove.

I would say it would probably be 50/50 due to the lack of witnesses.
 
the moving drivers fault, she could be parked facing the wrong way waving her arms about it'd still be his fault.
 
Not her fault at all. She was stationary and someone came down the road and hit her. It's their fault.
 
its going to depend on the accident damage to the other car

that will show if she drove into the side of their car or whether they drove into her stationary car
